APPLICANT: Palmer Estates, LLC c/o Dave Perry, Agent; David Perry Company, Inc.; 411 East Town Street, 1st Floor; Columbus, OH 43215; and Donald Plank, Atty.; Plank Law Firm; 411 East Town Street, 2nd Floor; Columbus, OH 43215.

 

PROPOSED USE: Multi-unit residential development.

 

GREATER SOUTH EAST AREA COMMISSION RECOMMENDATION:  Approval.

 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The applicant has received a recommendation of approval from Staff and the Development Commission for a concurrent rezoning (Ordinance #1768-2026; Z25-065) to the L-ARLD, Limited Apartment Residential District for a 32-unit townhouse-style development. The requested Council variance will allow a reduced building setback along Long Road from 40 to 30 feet and a reduced perimeter yard from 25 to nine feet along the eastern boundary of the site. A variance is required because the proposed development cannot meet all development standards of the L-ARLD, Limited Apartment Residential District, but results in a better site design with centralized open space and preservation of trees. Staff supports the proposed variances because Long Road will be widened and will include a multi-purpose trail along the southern boundary of the site, encouraging a more pedestrian-friendly site design in this area with buildings closer to the proposed trail.

To grant a Variance from the provisions of Sections 3333.18, Building lines; and 3333.255, Perimeter yard, of the Columbus City Codes; for the property located at 7500 LONG RD. (43110), to reduce the required building setback and perimeter yard for a multi-unit residential development in the L-ARLD, Limited Apartment Residential District (Council Variance #CV25-123).

 

Body

 

WHEREAS, by application #CV25-123, the owner of the property 7500 LONG RD. (43110), requests a Council variance to reduce the required building setback and perimeter yard for a multi-unit residential development in the L-ARLD, Limited Apartment Residential District; and

 

WHEREAS, Section 3333.18, Building lines, requires a minimum building setback line of 40 feet along Long Road, while the applicant proposes a reduced building setback line of 30 feet along Long Road; and

 

WHEREAS, Section 3333.255, Perimeter yard, requires a minimum perimeter yard of 25 feet, while the applicant proposes a reduced perimeter yard of nine feet along the east perimeter, as shown on the submitted site plan with Ordinance #1768-2026; Z25-065; and

 

WHEREAS, the Greater South East Area Commission recommends approval of said zoning change; and

 

WHEREAS, City Departments recommend approval because the requested variances will encourage a more pedestrian-friendly site design in this area with buildings closer to the proposed multi-purpose trail and centralized open space; and

 

WHEREAS, this ordinance requires separate submission for all applicable permits and Certificates of Occupancy for the proposed development; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 7500 LONG RD. (43110), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance is hereby granted from the provisions of Sections 3333.18, Building lines; and 3333.255, Perimeter yard, of the Columbus City Codes; for the property located at 7500 LONG RD. (43110), insofar as said sections prohibit a reduced building setback line from 40 to 30 feet along Long Road; and a reduced perimeter yard from 25 to nine feet along the east perimeter; said property being more particularly described as follows:

 

7500 LONG RD. (43110), being 2.25± acres located on the north side of Long Road; 150± feet east of Winding Path Drive, and being more particularly described as follows:

 

Situated in the City of Columbus, County of Franklin, State of Ohio; also being a part of Section 6, Township 15, Range 20 Congress Lands; also being those lands conveyed to Palmer Estates LLC as described in Instrument No. 202501270007866 Parcel I and Parcel II; being more particularly described as follows:

 

Commencing at Monument FCGS 5114 located at the intersection of the centerline of Long Road (right-of-way varies) and Bowen Road (80’ right-of-way), said point also being along the half-section line of Section 6, said point also being along the division line between City of Columbus and Madison Township; thence,

 

Along the centerline of Long Road, also being along the division line between City of Columbus and Madison Township, South 65° 55' 09” East, for a distance of 12.73’ to a point; thence,

 

Along a line through Long Road, South 04° 55' 09” West, for a distance of 42.51’ to a point along the northerly right-of-way line of Long Road, said point being the southeasterly corner of said lands of Palmer Estates LLC, said point also being the southwesterly corner of Sophie Village at Abbie Trails Part 2 as recorded in Plat Book 131 Page 79, said point also being the TRUE POINT OF BEGINNING, and from said beginning point running thence,

 

Along the northerly right-of-way line of Long Road and along the southerly line of said lands of Palmer Estates LLC, North 66° 25' 39” West, for a distance of 302.68' to a point; thence,

 

Along the westerly line of said lands of Palmer Estates LLC and along an easterly line of The Village at Abbie Trails Section 2 Part 2 Amended as recorded in Plat Book 109 Page 1, North 04° 13' 35” East, for a distance of 344.75' to a point; thence,

 

Along the northerly line of said lands of Palmer Estates LLC and along a southerly line of said The Village at Abbie Trails Section 2 Part 2 Amended, South 66° 06' 25” East, for a distance of 303.57' to a point; thence,

 

Along the easterly line of said lands of Palmer Estates LLC and along a westerly line of said Sophie Village at Abbie Trails Part 2, South 04° 16' 19” West, for a distance of 342.85' to the point of beginning, containing 2.255 acres of land, more or less.

 

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for those uses allowed in the L-ARLD, Limited Apartment Residential District, specified by Ordinance #1768-2026; Z25-065.

 

SECTION 3. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and Certificates of Occupancy for the proposed development.

 

SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
