PROPOSED USE:  Industrial development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on December 14, 2006.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested L-M, Limited Manufacturing District will allow industrial and office development.  The limitation text incorporates use restrictions, landscaping, and lighting controls.  This request is consistent with the land use recommendations of the South Alum Creek Neighborhood Plan (2003), and with the zoning and development patterns of the area.

WHEREAS, application #Z06-069 is on file with the Building Services Division of the Department of Development requesting rezoning of 2.05± acres from RRR, Restricted Rural Residential District, to L-M, Limited Manufacturing District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested L-M, Limited Manufacturing District will allow industrial and office development.  The limitation text incorporates use restrictions, landscaping, and lighting controls.  This request is consistent with the land use recommendations of the South Alum Creek Neighborhood Plan (2003), and with the zoning and development patterns of the area, now, therefore:    
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
2020 WATKINS ROAD (43207), being 2.05± acres located on the north side of Watkins Road, 416± feet west of New World Drive, and being more particularly described as follows:
 
Situated in the State of Ohio, County of Franklin, and in the Township of Marion, part of the east half of the southwest quarter as Quarter Section 1, Township 4, Range 22, described as follows:
 
Beginning at a point in the center of Watkins Road, which point is also the southwest corner of a tract containing 40 acres conveyed to Paul Childers by deed recorded in Deed Book 1270, Page 445,  Recorder's Office, Franklin County, Ohio;
 
Thence northerly along the west side of said 40 acre tract, 445.9 feet to an iron pin;
 
Thence easterly parallel with the north line of Watkins Road, 200 feet to an iron pin;
 
Thence southerly parallel with the west line of said 40 acre tract, 445.9 feet to a point in the center of Watkins Road;
 
Thence with the center of Watkins Road, westerly 200 feet to the place of beginning, containing 2.048 acres, more or less.

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the L-M, Limited Manufacturing District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved L-M, Limited Manufacturing District and Application among the records of the Building Services Division as required by Section 3370.03 of the Columbus City Codes; said text being titled, "LIMITATION OVERLAY TEXT,"  signed Douglas J. 1.  INTRODUCTION:  The 2.05+ acre site is currently vacant and is surrounded by land to the north and west in the M-1, manufacturing district, and land to the east in the L-M-1, Limited Manufacturing District.  The requested L-M, Limited Manufacturing District will establish standards that are consistent with surrounding L-M districts and the 2003 South Alum Creek Neighborhood Plan.
 
2.  PERMITTED USES:  Those uses permitted under Chapter 3363.01 - 3363.08 of the Columbus City Code excluding all adult entertainment establishments or adult stores, and excluding all commercial uses except for office uses.
 
3.  DEVELOPMENT STANDARDS:
 
A.  Density, Lot, and/or Setback Commitments.  N/A
 
B.  Access, Loading, Parking and/or Other Traffic Related Commitments.  N/A
 
C.  Buffering, Landscaping, Open Space, and/or Screening Commitments.
 
1.      To the extent that is possible, mature trees will be preserved at the time of development of the site.  Each tree that is removed will be replaced with a deciduous, ornamental, or evergreen tree.
 
2.      All trees and landscaping shall be well maintained.  Dead items shall be replaced within six months or the next planting season, whichever occurs first.
 
3.      All loading docks shall be screened from off-site view to a minimum height of six (6) feet by landscaping, fencing, walls, or buildings used individually or a combination thereof.
 
D.  Building Design and/or Interior-Exterior Treatment Commitments.  N/A
 
E.  Dumpsters, Lighting, Outdoor Display Areas, and/or other Environmental Commitments.
 
1.      The maximum height for any light poles shall be twenty (20) feet, and eighteen (18) feet within 100' of residentially zoned property.
 
2.      The external lighting shall be cut-off type (down-lighting).
 
3.      Buildings and landscaping may be up-lit or down-lit provided that the lighting does not spill over into the public right-of-way or onto neighboring properties.
 
F.  Graphics and/or Signage Commitments.
 
1.      All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code and any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.
 
G.      Miscellaneous Commitments.   
 
1.      At the time of submission for Zoning Clearance, the developer shall pay a parkland dedication fee of $400/acre to the City of Columbus.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
