Council Variance Application: CV25-059

 

APPLICANT:  Jonathan Romanovich; 2833 Oak Forest Drive; Grove City, OH 43123.

 

PROPOSED USE:  Residential development.

 

SOUTHWEST AREA COMMISSION RECOMMENDATION:  Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The site consists of two parcels each developed with a single-unit dwelling in the R, Rural District. A lot split has been proposed that will result in three new lots (Lot 1, Lot 2, and Lot 3). The requested Council Variance will allow a two-unit dwelling on Lot 1 and Lot 2, and will conform the development standards for the retained single-unit dwelling on Lot 3. A Council variance is required because the R district only allows single-unit dwellings as a primary residential land use. Variances to lot area, maximum side yard, and rear yard are also included in this request. The request is consistent with the Southwest Area Plan’s (2009) land use recommendation ofLow Density Residential” and Columbus Citywide Planning Policies (C2P2) Design Guidelines as the project includes a high-level of site and architectural design and is compatible with the surrounding residential development.

To grant a Variance from the provisions of Sections 3332.02, R-rural district; 3332.06, R-rural area district requirements; 3332.25, Maximum side yards required; and 3332.27, Rear yard, of the Columbus City Codes; for the property located at 1850 & 1870 TANIS DR. (43123), to allow residential development with reduced development standards in the R, Rural District (Council Variance #CV25-059).

 

Body

 

WHEREAS, by application #CV25-059, the owner of the property at 1850 & 1870 TANIS DR. (43123), is requesting a Council variance to allow residential development with reduced development standards in the R, Rural District; and

 

WHEREAS, Section 3332.02, R-rural district, allows one single-unit dwelling on a lot, while the applicant proposes a two-unit dwelling on both Lot 1 and Lot 2; and

 

WHEREAS, Section 3332.06, R-rural area district requirements, requires that a principal building shall be situated on a lot of no less than five acres, while the applicant proposes reduced lot areas of 0.11 acres, 0.11 acres and 0.13 acres for Lot 1, Lot 2, and Lot 3, respectively; and

 

WHEREAS, Section 3332.25, Maximum side yards required, requires the sum of the widths of the side yards to equal or exceed 20 percent of the width of the lot, or 19 feet for a lot width of 94.93 feet, while the applicant proposes to maintain reduced side yards totaling 18.9 feet for the retained single-unit dwelling on Lot 3; and

 

WHEREAS, 3332.27, Rear yard, requires each dwelling, residence or principal building shall be erected so as to provide a rear yard totaling no less than 25 percent of the total lot area, while the applicant proposes reduced rear yards of 15.9 percent on both Lot 1 and Lot 2, and 16 percent on Lot 3; and

 

WHEREAS, the Southwest Area Commission recommends approval; and

 

WHEREAS, the City Departments recommend approval because the request includes a high level of site design that is consistent with the Southwest Area Plan and C2P2 Design Guidelines and that is also compatible with the surrounding residential development.

 

WHEREAS, said ordinance requires separate submission for all applicable permits and a Certificate of Occupancy for each proposed two-unit dwelling on Lot 1 and Lot 2, and a Certificate of Zoning Clearance for the retained single-unit dwelling on Lot 3; and

 

WHEREAS, said variances will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variances will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 1850 & 1870 TANIS DR. (43123), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That a variance from the provisions of Sections 3332.02, R-rural district; 3332.06, R-rural area district requirements; 3332.25, Maximum side yards required; and 3332.27, Rear yard, of the Columbus City Codes; is hereby granted for the property located at 1850 & 1870 TANIS DR. (43123), insofar as said sections prohibit a two-unit dwelling on Lot 1 and Lot 2 in the R, Rural District; with reduced lot areas from five acres to 0.11 acres, 0.11 acres, and 0.13 acres for Lot 1, Lot 2, and Lot 3, respectively; a reduced maximum side yard from 19 feet to 18.9 feet for Lot 3; and reduced rear yards from 25 percent to 15.9 percent for Lot 1 and Lot 2, and to 16 percent for Lot 3; said property being more particularly described as follows:

 

1850 & 1870 TANIS DR. (43123), being 0.23± acres located on the north side of Tanis Drive; 425± feet west of Lazar Road, and being more particularly described as follows:

 

1850 Tanis Dr, Grove City OH 43123 (Parcel ID: 570-193868-00)

 

As to Parcel 3: Situated in the County of Franklin, State of Ohio, and in the City of Columbus, and bounded and described as follows:

 

PARCEL NO. 1:

Beginning at an iron pin at the Northeast corner of the John R. Haag Jr. farm tract

(Southeast corner of the Ralph R. and Dorothy A. Ryerson 6.706 acre tract) and in the South line of Virginia Military Survey No. 4641; thence along the East line of the Haag tract, South 4 deg. 40' West to the 19.71 feet to the point of the intersection of said line with the centerline of a 50 foot roadway; thence along the centerline of said roadway, South 83 deg. 55' East 399.44 feet to a point; said point being the true place of beginning for the tract herein intended to be described; thence North 6 deg. 05' East (passing an iron pin at 25.0 feet) 88.0 feet to an iron pin; thence South 83 deg, 55' East 60.0 feet to an iron pin; thence South 6 deg. 05' West (passing an iron pin at 63.0 feet) 88.0 feet to a point in the center line of the 50 foot roadway; thence along the centerline of said roadway, North 83 deg. 55' West 60 feet to the place of beginning, containing 0.121 acre, of which 0.034 is in said roadway.

SECTION 3.  That this ordinance is further conditioned on the subject site being developed in general conformance with the site plan titled, "SITE PLAN," dated September 8, 2025, and signed by Jonathan Romanovich, Applicant. The plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed.  Any slight adjustments to the plan shall be subject to review and approval by the Director of the Department Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.

 

SECTION 4.  That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for each proposed two-unit dwelling on Lot 1 and Lot 2, and a Certificate of Zoning Clearance for the retained single-unit dwelling on Lot 3.

 

SECTION 5.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
