Explanation
Background: This legislation authorizes the Public Service Director to enter into a professional services contract for the Facilities Management Division with Advanced Engineering Consultants, for professional engineering services associated with the renovation of the air conditioning cooling tower at 1393 East Broad Street. The air conditioning current cooling tower is in a serious state of disrepair. This state leads to additional maintenance costs and the potential of system failure.
Advanced Engineering Consultants will be responsible for design of a new air conditioning cooling tower, including all associated piping, valves, and electric. The design will include a new digital control system, a new concrete pad, and fencing with gates. Upon completion of the design, the Facilities Management Division will request bids in order to install the new cooling tower.
Per Columbus City Codes 329.10, informal proposals were solicited November 2, 2004, and submitted November 9, 2004. Five proposals were received as follows (1 MBE*, 1 FBE^, 1 MBR+):

The Facilities Management Division recommends the contract award to the most responsive and responsible bidder, Advanced Engineering Consultants.
This ordinance also authorizes the appropriation of $5,900.00 from the unappropriated balance of the General Permanent Improvement Fund.
Emergency action is requested so that work may begin as quickly as possible, thereby reducing maintenance costs and the possibility of a system failure. In addition, the after the completion of the professional services contract the Division will need to enter into contract for the repairs of the cooling tower, which must be done by June 2005.
Fiscal Impact: Funding is available in the General Permanent Improvement Fund. The lessee located at 1393 East Broad Street contributes $15,000.00 annually to said fund for costs and expenses relative to maintenance and repair of the property. The total cost of this professional engineering services contract is $5,900.00.

WHEREAS, the air conditioning cooling tower at 1393 East Broad Street is in disrepair, thereby causing increased maintenance costs, and threatening a system shutdown, and
WHEREAS, it is necessary to contract with a professional engineer in order to renovate the air conditioning cooling tower at 1393 East Broad Street, and
WHEREAS, the Facilities Management Division recommends acceptance of the bid submitted by Advanced Engineering Consultants, as the most responsive and responsible bidders, and
WHEREAS, it is neccessary to appropriate money from the General Permanent Improvement Fund in order to pay for said engineering services; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Facilities Management Division, in that it is immediately necessary to authorize the Public Service Director to contract with Advanced Engineering Consultants for professional services associated with the renovation of the air conditioning cooling tower at 1393 East Broad Street, so that there is no delay in this project, thereby preserving the public health, peace, property, safety and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director is hereby authorized to contract with Advanced Engineering Consultants for professional services associated with the renovation of the cooling tower at 1393 East Broad Street.
SECTION 2. That from the unallocated monies in the General Permanent Improvment Fund (Fund 748), and from any and all sources unallocated for any other purpose during the fiscal year ending December 31, 2004, the sum of $5,900.00 be and hereby is appropriated to the Public Service Department, Facilities Management Division 5907, OCA Code 590701, Object Level One - 06, Object Level Three - 6601.
SECTION 3. That the expenditure of $5,900.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 2, be and is hereby authorized and approved as follows:

SECTION 4. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves or vetoes the same.
