Council Variance Application: CV25-128

 

APPLICANT:  Jonathan Marsh; c/o Todd Levin; 1313 East Broad Street, Suite 201; Columbus, OH 43205

 

PROPOSED USE:  Exercise and gym facility.

 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The site is developed with a former pharmacy and drug store in the CPD, Commercial Planned Development District. The requested Council variance will allow the existing building to be repurposed into an exercise and gym facility. A Council variance is required because the CPD district only allows pharmacy and drug store uses in addition to associated accessory uses. Staff note that this proposal is consistent with the Far North Area Plan’s (2014) land use recommendation of “Commercial (Community)” land uses at this location and the Plan’s recommendation to reuse existing commercial and office development as appropriate and therefore is supportive of the request. Additionally, the site is under consideration for an updated land use recommendation of “Mixed Use 1” with the Columbus Growth Strategy (2026), which is consistent with the proposed use.

 

Title

 

To grant a Variance from the provisions of Section 3361.02, Permitted uses, of the Columbus City Codes; for the property located at 711 PARK RD. (43085), to allow exercise and gym facility uses in the CPD, Commercial Planned Development District (Council Variance #CV25-128).

 

Body

 

WHEREAS, by application #CV25-128, the owner of the property 711 PARK RD. (43085), requests a Council variance to allow exercise and gym facility uses in the CPD, Commercial Planned Development District; and

 

WHEREAS, Section 3361.02, CPD permitted uses, prohibits all uses except for pharmacy and drug store uses in addition to associated accessory uses within this specific CPD district, while the applicant proposes to allow an exercise and gym facility within the existing building; and

 

WHEREAS, City Departments recommend approval of the variance because the proposal is consistent with the Far North Area Plan’s land use recommendation of “Commercial (Community)” land uses at this location and is consistent with the Plan’s recommendation to reuse existing vacant commercial and office development; and

 

WHEREAS, this ordinance requires separate submission for all applicable permits and a Certificate of Zoning Clearance for the proposed exercise and gym facility; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 711 PARK RD. (43085), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance is hereby granted from the provisions of Section 3361.02, Permitted uses, of the Columbus City Codes; for the property located at 711 PARK RD. (43085), to allow exercise and gym facility uses in the CPD, Commercial Planned Development District; said property being more particularly described as follows:

 

711 PARK RD. (43085), being 1.7± acres located at the west corner of Park Road and Worthington-Galena Road, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin, City of Columbus, being in Lot 8, First Quarter, Township 2, Range 18, United States Military Lands, and being all of Parcel No. 2 conveyed to Vera M. Johnson in Official Record (OR) 22576 J-05, Franklin County Recorders Office;

 

All records referred to are recorded in the Franklin County Recorders Office;

 

TO FIND the place of beginning, COMMENCE at Franklin County Engineers Monument #7767 at the intersection of the centerlines of Worthington-Galena Road and Park Road, being the northeast corner of a 0.4895 acre tract conveyed to the City of Columbus in OR 9623 A-05;

 

THENCE South 39 degrees 51 minutes 58 seconds West, a distance of 246.84 feet, along the centerline of the said Worthington-Galena Road and the east line of the said 0.4895 acre tract, to a point, being the southeast corner of the said 0.4895 acre tract and the northeast corner of a 2.000 acre tract conveyed to LPK Development Company in OR 15976 E-19;

 

THENCE North 86 degrees 56 minutes 17 seconds West, a distance of 49.99 feet, along a south line of the said 0.4895 acre tract and the north line of the said 2.000 acre tract, to a found 3/4" iron pipe w/cap (stamped "EMHT"), being a southwest corner of the said 0.4895 acre tract and the southeast corner of the said Parcel No. 2, for the TRUE PLACE OF BEGINNING:

 

THENCE North 86 degrees 56 minutes 17 seconds West, a distance of 175.58 feet, along the south line of the said Parcel No. 2 and the north line of the said 2.000 acre tract, to a found 3/4" iron pipe (0.1' below grade), being the southwest corner of the said Parcel No. 2 and the southeast corner of 1.086 acre tract conveyed to Toby D. Marchio and Amy L. Marchio in OR 7549 H-08;

 

THENCE North 3 degrees 10 minutes 00 seconds East, a distance of 317.87 feet, along the west line of the said Parcel No. 2 and the east line of the said 1.086 acre tract, to a found 3/4" iron pipe at the northwest corner of the said Parcel No. 2 and the southwest corner of the said 0.4895 acre tract;

 

THENCE South 86 degrees 50 minutes 27 seconds East, a distance of 62.32 feet, along a north line of the said Parcel No. 2 and a south line of the said 0.4895 acre tract, to a found 3/4" iron pipe w/cap (stamped "EMHT") being a corner of the said Parcel No. 2 and of the said 0.4895 acre tract:

 

THENCE around a curve in a clockwise direction having a delta angle of 30 degrees 00 minutes 00 seconds, an arc distance of 85.48 feet, a radius of 163.26 feet, and a chord of South 71 degrees 50 minutes 27 seconds East, a distance of 84.51 feet, along a north line of the said Parcel No. 2 and south line of the said 0.4895 acre tract, to a point referenced by a found 3/4" iron pipe w/cap (stamped “ЕМНТ"), 0.02' N. 0.14' E), being a corner of the said Parcel No. 2 and of the said 0.4895 acre tract;

 

THENCE South 56 degrees 49 minutes 30 seconds East, a distance of 188.42 feet, along a north line of the said Parcel No. 2 and a south line of the said 0.4895 acre tract, to a set iron pin, being a northeast corner of the said Parcel No. 2 and a corner of the said 0.4895 acre tract;

THENCE South 8 degrees 39 minutes 03 seconds East, a distance of 19.93 feet, along a east line of the said Parcel No. 2 and a west line of the said 0.4895 acre tract, to a set iron pin, being a northeast corner of the said Parcel No. 2 and a corner of the said 0.4895 acre tract;

 

THENCE South 39 degrees 51 minutes 58 seconds West, a distance of 226.93 feet, along a east line of the said Parcel No. 2 and a west line of the said 0.4895 acre tract, to the TRUE PLACE OF BEGINNING containing 74170 square feet or 1.703 acres, according to a survey by Paul K. Moore and Associates on November 13, 1995;

 

All iron pipes found are at grade and in good condition, unless otherwise noted, and all iron pins set are 5/8" iron pins w/caps stamped "P K MOORE RS 5883";

 

The Basis of Bearings for this survey is the west line of the said Parcel No. 2 as being North 3 degrees 10 minutes 00 seconds East, as shown in OR 22576 J-06, and is used to denote angles only.

 

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for exercise and gym facility uses, or those uses allowed in the CPD, Commercial Planned Development District, specified by Ordinance #0598-96; Z95-135.

 

SECTION 3.  That this ordinance is further conditioned on the applicant obtaining all applicable permits and Certificates of Zoning Clearance for the proposed exercise and gym facility.

 

SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
