Explanation
 
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into an agreement with Korda/Nemeth Engineering, Inc. in the amount of $181,700.00, for professional engineering services for the Canyon Drive Water Line Improvements Project, Division of Power and Water Contract Number 1107.
 
This project consists of preparing detailed engineering plans that are suitable for bidding and constructing various waterline improvements.  The five locations and work descriptions are described below.  
 
1.      Construct a 6-inch water main in Foster Street from the existing 6-inch water main in Northridge Road to the existing 6-inch water main in Blenheim Road.  Transfer all existing taps to the new water main and abandon the existing 2-inch water main.  (Approximately 300 feet)
 
2.      Transfer all existing taps from the existing 2-inch water main in Glenmont Place, between Glenmont Avenue and Canyon Drive, to the existing 8-inch water main.  Abandon the existing 2-inch water main.
 
3.      Construct an 8-inch water main, including fire hydrants, in Lenappe Drive from the existing 8-inch water main in Overbrook Drive to a proposed 8-inch water main in Canyon Drive North.  Transfer all existing taps to the new water main and abandon the existing 8-inch water main.  (Approximately 1,350 feet)
 
4.      Construct an 8-inch water main, including fire hydrants, in Canyon Drive from Sharon Avenue east to the intersection of Canyon Drive North and Canyon Drive.  Transfer all existing taps to the new water main and abandon the existing 8-inch water main.  (Approximately 2,400 feet)
 
5.      Construct an 8-inch water main, including fire hydrants, in Overbrook Drive from Cooke Road to Yaronia Drive. Then from Yaronia Drive to Wynding Drive.  Transfer all existing taps to the new water main and abandon the existing water mains.  (Approximately 1,600 feet)    
 
2. BID INFORMATION:  The selection of the firm providing the professional engineering services has been performed in accordance with the procedures set forth in Columbus City Code, Section 329.14, "Awarding professional service contracts through requests for proposals."  The evaluation criteria for this contract included:  1. proposal quality, 2. project schedule, 3. environmentally preferable offeror, and 4. local workforce.
 
Statements of Qualifications were received on July 20, 2007.  Three consultants were selected to submit technical proposals for this project.  Korda/Nemeth Engineering, Inc., Ltd., EMH&T, Inc., and M-E Companies submitted proposals on November 21, 2007.  
 
Upon review of the technical proposals, the bidders were ranked using the criteria mentioned above and Korda/Nemeth Engineering, Inc. was the firm selected to perform the design services for this project.  Their Contract Compliance Number is 31-0922991 (expires 9/28/09, Majority).  Additional information regarding each bidder, description of work, contract time frame and detailed amounts can be found on the attached Legislation Information Form.
 
3.  FISCAL IMPACT:  This legislation includes a transfer of funds within the Water Works Enlargement Voted Bonds Fund and an amendment to the 2007 Capital Improvements Budget.  This ordinance will also allow the appropriation of funds due to transfers from the Water Limited Bonds Fund.

WHEREAS, three technical proposals for the Canyon Drive Water Line Improvements Project were received on November 21, 2007; and
 
WHEREAS, Korda/Nemeth Engineering, Inc. was the firm selected to perform the design services for this project based on criteria set forth in Columbus City Codes; and
 
WHEREAS, the purpose of this project is to prepare detailed engineering plans that are suitable for bidding and constructing various waterline improvements, for five locations around the Canyon Drive area; and
 
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient funding and expenditure authority for the aforementioned project expenditures; and
 
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Water Works Enlargement Voted 1991 Bonds Fund; and
 
WHEREAS, it is necessary to appropriate funds transferred from the Water Limited Bonds Fund; and
 
WHEREAS, it has become necessary in the usual daily operation of the Division of Power and Water, Department of Public Utilities, to authorize the Director of Public Utilities to enter into an agreement with Korda/Nemeth Engineering, Inc. for professional engineering services for the Canyon Drive Water Line Improvements Project, for the preservation of the public health, peace, property and safety; now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities be and hereby is authorized to enter into an agreement for professional engineering services for the Canyon Drive Water Line Improvements Project; with Korda/Nemeth Engineering, Inc., Ltd., 1650 Watermark Drive, Columbus, Ohio 43215; in the amount of $181,700.00; in accordance with the terms and conditions of the contract on file in the Office of the Division of Power and Water.
 
SECTION 2.  That said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Power and Water.
 
SECTION 3. That the City Auditor is hereby authorized and directed to appropriate $36,865.48, due to transfers from the Water Limited Bonds Fund, as follows:

SECTION 7.  That for the purpose of paying the cost of the engineering agreement, the following expenditure, or as much thereof as may be needed is hereby authorized as follows:  Division of Power and Water (Water), Dept./Div. No. 60-09, Water Works Enlargement Voted Bonds Fund, Fund No. 606, Project 690236, OCA Code 642900, Object Level One 06, Object Level Three 6629, Amount $181,700.00.
 
SECTION 8.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 9.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 10.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 11.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
