Explanation
 
1.  BACKGROUND  
This ordinance authorizes the Director of Public Service to accept the Federal Identification number change of G & G Cement Contractors and the assignment of all their present and future contracts with the City of Columbus to G & G Cement Contractors, LLC.   These actions are a result of the change of G & G Cement Contractors from a partnership to a corporation on July 1, 2008.  The Department of Public Service currently has several construction agreements with G & G Cement Contractors.  G & G Cement Contractors will continue to provide the services for these agreements in accordance with existing contract terms and provisions.  This legislation will not alter the balances of any existing contracts covered by this assignment.
 
The new Contract Compliance number for G & G Cement Contractors, LLC is 26-2560462 (expiration date June 26, 2010).
 
2.  EMERGENCY DESIGNATION
Emergency action is requested so that payments for existing contracts with this vendor can proceed without interruption and applied to the correct company name and federal identification number in order to  maintain proper accounting practices.
 
3.  FISCAL IMPACT
This legislation will not alter the balances of any existing contracts covered by this assignment.

Body
WHEREAS, the Department of Public Service  has entered into multiple contracts with in connection with multiple construction agreements; and
 
WHEREAS, it is necessary to alter existing contracts with G & G Cement Contractors to reflect a name and Federal Identification Number change as a result of their change from a partnership to a corporation; and  
 
WHEREAS, G & G Cement Contractors, LLC has informed the Director of Public Service of its intentions to fulfill its contractual obligations; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Transportation, these changes should go forth immediately so that the payments to this contractor may proceed without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.   That the Director of Public Service is hereby authorized and directed to modify present and future contracts to reflect the company name change and Federal Identification Number of G & G Cement Contractors to G & G Cement Contractors, LLC, contract Compliance number 26-2560462.
 
Section 2.  That the City Auditor is hereby authorized to assign all construction contracts for G & G Cement Contractors to G & G Cement Contractors, LLC.
 
Section 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
