APPLICANT:  Jacquelyn A. and Herbert W Debus, jr.; c/o Donald T. Plank, Atty.; 145 East Rich Street; Columbus, Ohio 43215.Smiley Drive; Canal Winchester, Ohio 43110.
      
PROPOSED USE:  Single-family residential development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on March 13, 2003.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested R-2, Residential District is an appropriate transitional land-use from the more intense manufacturing, commercial and multi-family districts along South High Street corridor to the larger lot single family and farmland uses to the east. The application includes a letter agreeing to restrictions and covenants, including minimum lot size, maximum number of units, minimum building size, and tree preservation and fencing commitments, that will appear on the subdivision plat.  The proposal is consistent with the land-use recommendations of the South Central Accord.

WHEREAS, application #Z02-111 is on file with the Building Services Division of the Department of Development requesting rezoning of 60.7± acres from R, Rural District (annex), to R-2, Residential District; and
 
WHEREAS, the Development Commission recommends Approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested R-2, Residential District is an appropriate transitional land-use from the more intense manufacturing, commercial and multi-family districts along South High Street corridor to the larger lot single family and farmland uses to the east.  The application includes a letter agreeing to restrictions and covenants, including minimum lot size, maximum number of units, minimum building size, and tree preservation and fencing commitments, that will appear on the preliminary subdivision plat.  The proposal is consistent with the land-use recommendations of the South Central Accord, now, therefore:    
 
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
4699 Parsons Avenue (43207), being 60.7± acres located on the west side of Parsons Avenue, 910± feet north of Rathmell Road, and being more particularly described as follows:

Situated in the State of Ohio, County of Franklin, Township of Hamilton, located in Section 21, Township 4, Range 22, Congress Lands being that tract of land conveyed to Jacquelyn A. Debus and Herbert W. Debus Jr. by deed of record in Instrument Number 199808190211067 (all references refer to the records of the Recorder's Office, Franklin County, Ohio) and more particularly bounded and described as follows:
 
Beginning at the southwesterly corner of said Debus tract, the northwesterly corner of that tract conveyed to Churches of Christ in Christian Union by deed of record in Official Record 33878E18;
 
      thence North 04° 18' 00" East, a distance of 1757.85 feet to a point;
 
      thence South 86° 06' 42" East, a distance of 1655.03 feet to a point;
 
      thence South 03° 50' 38" West, a distance of 612.66 feet to a point;
 
      thence North 86° 03' 43" West, a distance of 694.03 feet to a point;

Section 2.  That a Height District of Thirty-five (35) feet is hereby established in the R-2, Residential District on this property.
 
Section 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
