Explanation

 

Background:  This legislation authorizes the Public Service Director to enter into a contract in an amount up to $1,039,185.21 for the Champion Avenue Improvement project and to pay construction inspection costs up to $149,271.00 for the Transportation Division.  This improvement will rehabilitate the pavement on Champion Avenue between Williams Road and Hilock Road and provide new sidewalks, curb ramps, and curbs and gutters.  The estimated Notice to Proceed date is June 12, 2005.  The contractor has been given 365 days to complete the construction of the project.  The project was let by the Transportation Division and was advertised in the City Bulletin, Dodge Reports and by the Builders Exchange.  Seventeen bidders/suppliers were solicited (16 majority, 1 minority) and 9 bids were received (8 majority, 1 minority) and tabulated on March 15, 2005 as follows:

The Transportation Division recommends a bid award to Nickolas Savko and Sons, Incorporated, Contract Compliance # 31-0907362 (expires September 17, 2005) as the lowest, best, most responsive, and most responsible bidder.

 

Fiscal Impact:  The Transportation Division budgeted $2.14 million in the 2004 Capital Improvements Budget (CIB) for Roadway Improvement projects.  All but approximately $41,000.00 of this money from the July 2004 bond sale has been either encumbered or spent on various roadway improvement projects.  This ordinance authorizes an expenditure of $1,188,456.21.  This ordinance transfers $1,147,521.76 from the Urban Infrastructure project to the Roadway Improvements project within this Fund; the current balance [net of other pending legislation] in the Roadway Improvements project is $40,934.45.

 

Emergency action is requested to allow construction to commence in June 2005 to take full advantage of favorable weather.

To authorize the City Auditor to transfer $1,147,521.76 between projects within the 1995, 1999 Voted Streets and Highways Fund; to authorize the Public Service Director to enter into a contract with Nickolas Savko and Sons, Incorporated, for construction of the Champion Avenue Improvement project for the Transportation Division; to authorize the expenditure of $1,188,456.21 from the 1995, 1999 Voted Streets and Highways Fund, and to declare an emergency.  ($1,188,456.21)

 

 

Body

 

WHEREAS, bids were received on March 15, 2005, and tabulated on March 16, 2005, for the Champion Avenue Improvement project and a satisfactory bid has been received; and

 

WHEREAS, it is necessary to provide for construction inspection costs; and

 

WHEREAS, it is necessary to authorize a transfer of funds for the project to proceed; and

 

WHEREAS, an emergency exists in the usual daily operation of the Transportation Division in that the contract should be awarded immediately to allow construction to commence in June, 2005 to take full advantage of favorable weather, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the transfer of $1,147,521.76 between projects within Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, be and hereby is authorized as follows:

SECTION 2.  That the Public Service Director be and hereby is authorized to enter into a contract with Nickolas Savko and Sons, Incorporated, 4636 Shuster Road, Columbus, Ohio 43214, for the construction of the Champion Avenue Improvement project in the amount of $1,039,185.21 for the Transportation Division in accordance with the specifications and plans therefore on file in the office of the Public Service Director, which are hereby approved, and to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $149,271.00 therefore.

 

SECTION 3.  That for the purpose of paying the cost of the contract and inspection, the sum of $1,188,456.21 or so much thereof as may be necessary, be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 644385 and project 530161.

 

SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
