APPLICANT:  Mohand Azzabene; 1702 Bennigan Drive; Hilliard, OH 43026

 

PROPOSED USE:  Limited commercial development.

 

DEVELOPMENT COMMISSION RECOMMENDATION: Approval (5-0) on December 12, 2024.

 

GREATER HILLTOP AREA COMMISSION RECOMMENDATION: Approval

 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The 0.47± acre site consists of two undeveloped parcels, one in the R-2, Residential District, and the other in the R, Rural District. The requested L-C-4, Limited Commercial District will allow limited commercial development. The limitation text includes appropriate use restrictions, and supplemental development standards addressing parking, traffic access, and graphics. The site is within the planning boundaries of the Hilltop Land Use Plan (2019), which recommends “Mixed Use 1 (<24 du/ac)” land uses at this location. The proposal is consistent with that land use recommendation, and will not introduce an incompatible use to the area.

WHEREAS, application #Z24-026 is on file with the Department of Building and Zoning Services requesting rezoning of 0.47± acres from R-2, Residential District and R, Rural District, to L-C-4, Limited Commercial District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the Greater Hilltop Area Commission recommends approval of said zoning change; and

 

WHEREAS, the City Departments recommend approval of said zoning change because the requested L-C-4, Limited Commercial District includes appropriate use restrictions, and supplemental development standards consistent with the land use recommendations of the Hilltop Land Use Plan, and will not introduce an incompatible use to the area; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

2194 & 2202 EAKIN RD. (43205), being 0.47± acres located at the northeast corner of Eakin Road and Whitethorne Avenue, and being more particularly described as follows:

Situated in the City of Columbus, County of Franklin, and State of Ohio:

 

Being Lot Number 56 in Rainbow Addition as the same is numbered and delineated upon the recorded plat thereof of record in Plat Book 16, Page 63, Recorder's Office, Franklin County, Ohio.

 

Less and excepting therefrom the following 0.003 ac tract conveyed by Robert E. Lindemann, Trustee & Polly B. Lindermann to the City of Columbus, Ohio by Official Record 24615A14:

 

Situated in the State of Ohio, County of Franklin, City of Columbus and being out of Lot Number 56 as same is designated and delineated upon the recorded plat of Rainbow Addition, of record in Plat Book 16, Page 63 (all references used in this description refer to the records of the Recorder's Office, Franklin County, Ohio), conveyed to Robert and Polly B. Lindemann and being more particularly described as follows:

 

Beginning at the southwest corner of said Lot Number 56 at the intersection of the north right-of-way of Eakin Road with the east right-of-way of Whitethorne Avenue;

 

Thence North 12° 18' 00" East, with the east right-of-way of said Whitethorne Avenue, the west line of said Lot Number 56, a distance of 15.00 feet to a point;

 

Thence South 33° 03' 30" East, with a new division line across said Lot Number 56, a distance of 21.08 feet to a point in the south line of said Lot Number 56, the north right-of-way of said Eakin Road;

 

Thence North 78° 25' 00" West, with the south line of said Lot Number 56, the north
