DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (4-0) on March 11, 2004.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested C-1, Commercial District to permit a florist business is consistent with the land use and zoning patterns of the area.

WHEREAS, application #Z04-016 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.14± acres from R-4, Residential District, to the C-1,  Commercial District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested C-1, Commercial District to permit a florist business is consistent with the land use and zoning patterns of the area, now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
2789 EAST FIFTH AVENUE (43219), being 0.14± acres located on the south side of East Fifth Avenue, 100± feet west of Morris Avenue, and being more particularly described as follows:
 
Being Lot Number Four Hundred Forty-one (441) and the west one-half of Lot Number Four Hundred Forty -two (442) of EAST COLUMBUS ADDITION, as the same are numbered and delineated upon the recorded plat thereof, of record in the office of the Recorder of Franklin County, Ohio, the said plat being recorded in Plat Book 5, page 364.
 
To Rezone From: R-4,  Residential District,
 
To: C-1, Commercial District
 
Section 2.  That a Height District of thirty-five (35) feet is hereby established on the C-1, Commercial District on this property.
 
Section 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
