Explanation

BACKGROUND:
This ordinance authorizes the Director of the Office of Diversity and Inclusion to modify an existing professional services contract with NK Industries, LLC to support the continued implementation of the B2GNow system and to expand supplier development system support and program development initiatives.  The current contract term is from January 1, 2025 through December 31, 2025.

Reason additional goods/services could not be foreseen:
This modification was not anticipated at the time of the original and modified contracts due to unforeseen requirements that arose during the comprehensive redevelopment of the City’s supplier development program. As the initiative progressed, significant policy revisions, expanded programmatic needs, and evolving compliance standards necessitated additional services to ensure successful implementation and alignment with the City’s strategic goals.

 

Reasons other procurement processes are not used:
NK Industries, LLC is uniquely qualified to accomplish this project and to provide expert consultation on the supplier development program.

How cost of modification was determined:
The costs of this contract modification are consistent with the direct labor, overhead, and market standards established within the original contract.

FISCAL IMPACT: This ordinance authorizes an expenditure of $150,000.00 from the General Fund and the transfer of $150,000.00 within the General Fund. These funds are budgeted and available in the General Fund.

 

EMERGENCY DESIGNATION: Emergency action is requested to ensure uninterrupted operations of the supplier development program.

Body

WHEREAS, the original contract number, PO461898 was created and approved on August 1, 2024, with contract terms from August 5, 2024 to December 31, 2024 for the B2GNow system implementation and supplier development support services, and

 

WHEREAS, the modified contract number, PO477822 was created and approved on December 6, 2024, with contract terms dates from January 1, 2025-December 31, 2025 for the B2GNow system implementation and supplier development support services, and

 

WHEREAS, it is necessary to authorize an expenditure of up to $150,000.00 from the General Fund, Fund 1000; and

 

WHEREAS, an emergency exists in the usual daily operation of the Office of Diversity and Inclusion in that it is immediately necessary to authorize the Director to modify an existing professional services contract with NK Industries, LLC to increase funding for the continued implementation of the B2GNow system, expansion of supplier development support services, and advancement of program and policy enhancements, in order to maintain project continuity and meet critical operational timelines, all for the immediate preservation of the public health, peace, property, safety, and welfare; and now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of the Office of Diversity and Inclusion is hereby authorized to modify an existing professional services agreement with NK Industries, LLC for the continued implementation of the B2GNow system, expansion of supplier development support services, and advancement of related program and policy enhancements, in accordance with the terms and conditions of the contract on file in the Office of Diversity and Inclusion.

 

SECTION 2.  That the transfer of $150,000.00, or so much thereof as may be needed is hereby authorized within the General Fund 1000 from Dept-Div 40-4003 Object Class 01, to Dept-Div 40-4003, Object Class 03 per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the expenditure of up to $150,000.00 is hereby authorized from the General Fund, Fund 1000 per the accounting codes attached to this ordinance.

 

SECTION 4.  That the funds are deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
