Explanation
Global One Security and Investigations, Inc., was awarded the security contract for contractual services in the Municipal Court Building in the fall of 2001, pursuant to Bid Proposal SA-000093-GM, opened publicly on October 11, 2001. During the first year of the three year contract, which commenced February 1, 2002, with one additional option year, Court Security Management complained to Court Administration that Global One Security was in non--compliance of several formal bid specifications subsequent to the initial three months of the contract. Repeated attempts by Court Security Management with Global management were unsuccessful during the remaining nine months. Court Adminstration in conjunction with Court Security Management intended to formally address these issues at the inception of the second year of the contract approximately February 1, 2003. However, it had since been discovered that Global One Security failed to provide the required Performance Bond in the initial year of the contract, nor have they been able to acquire this bond during the modified four month contract, February 1, 2003 through May 31, 2003. The court subsequently exercised its contractual right and issued a thirty day contract termination notice on May 31, 2003, effective June 30, 2003.
BID INFORMATION: Informal bids were sent to four (4) vendors to fulfill the remaining seven (7) months of the second contractual year, July 1, 2003 through January 31, 2004. Court staff will be meeting in the very near future with the Division of Purchasing to formulate specifications for the formal bid process for a new three year contract, to commence February 1, 2004, with one additional option year.

To authorize the Department of Municipal Court Judges, through the Administrative/Presiding Judge, to enter into a seven (7) month contract with Willo Security, Inc., for the provision of security guard services in the Municipal Court Building, to authorize the expenditure of $167,566.80 from the Municipal Court Special Projects Fund, to waive all applicable provisions of the Columbus City Codes relative to competitive bidding and to declare an emergency. WHEREAS, the continuation of security services in the Municipal Court Building located at 375 S. High Street, is absolutely necessary for the safety and well being of the employees and the general public pursuant to the original bid specifications addressed in Bid Proposal No. SA-000093-GM, and until such time that this security contract can be formally rebid, and
WHEREAS, it is necessary to authorize the Administrative/Presiding Judge to enter into this security contract with Willo Security, Inc., effective July 1, 2003, so as to continue the daily operation of the court, and for all other tenants within the court building, and
WHEREAS, it is necessary to waive all applicable provisions of the Columbus City Codes relative to competitive bidding, and
WHEREAS, informal bids were solicited from vendors that provide contractual security guard services, and
WHEREAS, an emergency exists in the usual daily operation of the Municipal Court Judges in that it is immediately necessary to enter into said contract for the preservation of the public health, peace, safety and welfare; now therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Department of Municipal Court Judges, through the Administrative/Presiding Judge, be and is hereby authorized to enter into a seven (7) month contract with Willo Security Inc., for the provision of security guard services in the Municipal Court Building.
SECTION 2. That the expenditure of $167,566.80 beginning July 1,2003 to January 31, 2004, or so much thereof as may be necessary is authorized to be expended from the Municipal Court Special Project Fund, Fund 226, Department No. 25-01, OCA Code 226001, Object Level One 03, Object Level Three 3336, to pay the costs thereof.
SECTION 3. That for the reasons stated, the Columbus City Council finds it is in the best interest of the City of Columbus to waive all provisions in the Columbus City Codes relative to competitive bidding.
SECTON 4. For the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after passage if the Mayor neither approves nor vetoes the same.
