PROPOSED USE: Elderly Housing development.
                                                                                 
CITY DEPARTMENTS' RECOMMENDATION:  Disapproval.  The applicant requests this Council variance concurrently with rezoning Z06-011, to vary side yard setbacks from 20-feet to 12-feet on the west side of the property and 11 -feet on the east side of the property.  A PUD-6 approved in December of 2002 (Z02-044), lies to the east of this site.  That PUD features a 25-foot setback on the perimeter.  The PUD-6 to the west of this site (Z02-054), was approved in July 2003 and also includes a 25- foot perimeter setback.  Staff finds the proposed variance to be unwarranted and inconsistent with the established zoning pattern of the area.  The reduced setbacks will limit the ability for trees to grow in these areas, while the applicant provides excess room on the interior of the site.  Staff finds this to be overdevelopment at the expense of the surrounding developments.  No recommendation is being made regarding the Hardship aspect of this request.

WHEREAS, by application #CV06-031, the owner of property at 5565 BROADVIEW ROAD (43230), is requesting a Variance for elderly housing with reduced side yard setbacks concurrently with rezoning Z06-011 in the I, Institutional District; and
 
WHEREAS, Section 3349.04(c), Height, area and yard regulations, requires a side yard of twenty (20) feet, while the applicant proposes a side yard setback of eleven (11) feet on the east and twelve (12) feet on the west; and
 
WHEREAS, City Departments recommend disapproval noting that the proposed variance is unwarranted and inconsistent with the established zoning pattern of the area.  The reduced setbacks will limit the ability for trees to grow in these areas, while the applicant provides excess room on the interior of the site.  Staff finds this to be overdevelopment at the expense of the surrounding developments; and
 
WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed use; and
 
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
 
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and
  
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at  5565 BROADVIEW ROAD (43230), in using said property as desired; now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That a variance from the provisions of Section 3349.04 (c), Height, area and yard regulations of the Columbus City Codes for the property located at 5565 BROADVIEW ROAD (43230), insofar as said sections prohibit a elderly housing development with a side yard reduced from 20-feet to 12-feet on the west side of the property and 11-feet on the east side of the property; said property being more particularly described as follows:
 
5565 BROADVIEW ROAD (43230), being 3.97± acres located on the south side of Broadview Road, directly south of Panorama Drive and being more particularly described as follows:

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
