Explanation
BACKGROUND: This legislation amends the 2005 Capital Improvements Budget for the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund 553. Amendments are necessary to increase budget authority for additional carryover funds made available through encumbering document cancellations and to realign authority due to previous cash transfers among projects within the fund.
Emergency action is requested in order that the budget authority may be amended as soon as possible, thereby allowing the Division of Electricity to proceed with legislation for capital improvements projects.
FISCAL IMPACT: This legislation amends carryover funding to reflect document cancellations and cash transfers among project within the Voted 1995 and 1999 Street Lighting and Electricity Distribution System Improvements Fund. There is no impact on new funding.

To increase and amend carryover funding in the 2005 Capital Improvements Budget due to encumbering document cancellations and cash transfers within the Voted Street Lighting and Electricity Distribution Improvements Fund and to declare an emergency. ($140,071)

WHEREAS, cancellations of encumbering documents have made additional carryover funding available in the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund; and
WHEREAS, amendments of carryover funding in the 2005 Capital Improvements Budget are necessary to align project amounts with previously authorized cash transfers among the projects within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Electricity, in that it is immediately necessary to amend the 2005 Capital Improvements Budget to provide budget authority in the appropriate capital improvements projects thereby preserving the public health, peace, property, safety and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That carryover funding in the 2005 Capital Improvements Budget is hereby amended due to additional funds made available through encumbering document cancellations and to amend project amounts to align with previous cash transfers authorized within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund 553, as follows:

SECTION 2. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
