Explanation
This legislation authorizes the Director of Public Utilities to enter into a cooperative agreement that sets forth the terms of installation for a fence segment to close a gap between the existing fence located on City-owned property at 1600 West Mound Street, Columbus, Ohio 43223 (“City Property”) and the shared property line between the City Property and the property owned by PRS MOUND LLC located at 1590 W Mound St, Columbus, Ohio 43223 (“Adjacent Property”).
FISCAL IMPACT:
There is no fiscal impact to enter into the cooperative agreement. The cost of the fence installation will be submitted for City Council approval under separate legislation, if needed, after the cost is determined.
EMERGENCY DESIGNATION:
This legislation is being put forth as an emergency measure in order to expedite the fence installation to stop the trespassing that has been occurring on the properties.

WHEREAS, there is an existing fence located on City-owned property at 1600 West Mound Street, Columbus, Ohio 43223 (“City Property”) and the shared property line between the City Property and the property owned by PRS MOUND LLC located at 1590 W Mound St, Columbus, Ohio 43223 (“Adjacent Property”),and
WHEREAS, there is a gap in the current fence through which there has been unauthorized access; and
WHEREAS, the City and PRS Mound LLC desire to enter into a cooperative agreement to close the gap; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to enter into a cooperative agreement with PRS MOUND LLC to close the gap in the adjoining fence to stop trespassing that has been occurring on the properties, without delay, all for the immediate preservation of the public health, peace, property, safety and welfare; and now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Utilities is hereby authorized to enter into a cooperative agreement with PRS MOUND LLC for closure of a gap in the fence segment along the property boundary on City-owned property at 1600 West Mound Street, Columbus, Ohio 43223 (“City Property”) and the shared property line between the City Property and the property owned by PRS MOUND LLC located at 1590 W Mound St, Columbus, Ohio, 43223.
SECTION 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
