Explanation
Background: This legislation is to authorize and direct the Recreation and Parks Department Director to enter into contract with Wright’s Concessions, for food concessions/catering at Berliner Sports Complex as a result of waiving the competitive bidding provisions of the Columbus City Code 329.
The waiving of Columbus City Code 329 is in the best interest of the City as Wright’s has been providing concessions at Berliner Sports Complex, only under contract with a non-profit entity. The intent is to have Wright’s contract with the City for those services this sports season, then put out the Berliner concession services contract to bid next year.
Bid Waiver Justification: Wright’s already has the infrastructure in place to provide the services for next season, which begins in February, and delaying this contract’s implementation will mean that there would not be concessions provided at Berliner this coming sports season.

Master Plan Relation: Food Concessions is an integral part of sports complexes. Berliner Sports Complex - the state’s premier softball complex - continues to support the mission of the Recreation and Parks Master Plan by ensuring a strong customer base with successful on-going revenue producing operations.
Fiscal Impact: Revenue will be paid to Recreation and Parks and contribute to the sustainability of the Sports Division.

To authorize and direct the Director of the Recreation and Parks Department to enter into contract with Wright’s Concessions, LLC, for food concessions/catering at Berliner Sports Complex; and to waive the competitive bidding requirements under Chapter 329 of the Columbus City Codes. ($0)

WHEREAS, it is necessary to authorize and direct the Recreation and Parks Department Director to enter into contract with Wright’s Concessions, LLC, for food concessions/catering at Berliner Sports Complex; and
WHEREAS, it is in the best interest of the City to waive the competitive bidding provisions of City Code Chapter 329 to contract directly with Wright’s Concessions, LLC; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Recreation and Parks Department be and is hereby authorized and directed to enter into contract with Wright’s Concessions, LLC, for food concessions/catering at Berliner Sports Complex.
SECTION 2. That this Council finds it to be in the best interests of the City to waive the relevant provisions of Chapter 329 of Columbus City Codes relating to competitive bidding for this agreement and does hereby waive the same.
SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
