Rezoning Application Z25-039

 

APPLICANT: 3812 Powell Road, LLC; c/o Molly Gwin, Atty.; 250 West Street, Suite 700; Columbus, OH 43215.

                     

PROPOSED USE: Commercial uses.

 

DEVELOPMENT COMMISSION RECOMMENDATION: Approval (5-1) on November 13, 2025.

 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The 1.49± acre site consists of two parcels developed with two vacant commercial buildings and a cell tower in the R, Rural District, as result of recent annexation into the City of Columbus. The requested C-4, Commercial District will allow commercial uses, including retail uses such as a dispensary at this location. The site is located within the planning area of the Far North Area Plan (2014), which recommends “Mixed Use (Regional)” land uses at this location. The Plan also recommends redevelopment and reuse of vacant and underutilized commercial and office sites in a manner consistent with the land use plan and recommended design guidelines. Staff also notes that this area is under consideration for an updated land use recommendation and corresponding zoning as part of Zone In: Economic & Housing Opportunity. The draft generalized land use recommendation is Mixed Use, which is consistent with the requested district. Because the site is already developed, the current design guidelines of the Far North Area Plan are not applicable. As the site will likely be rezoned to a Title 34 zoning district as part of the Zone In initiative, appropriate design guidelines will be applied at that time. Staff supports the request for an unrestricted C-4 district with the understanding that the screening required by Section 3321.09 will need to be installed along the north and west property lines within nine months of the issuance of a Certificate of Occupancy for the intended use.

WHEREAS, application #Z25-039 is on file with the Department of Building and Zoning Services requesting rezoning of 1.49± acres from R, Rural District, to C-4, Commercial District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the City Departments recommend approval of said zoning change because the requested C-4, Commercial District is consistent with the Far North Area Plan’s land use recommendation. Because the site is already developed, the current design guidelines of the Plan are not applicable. As the site will likely be rezoned to a Title 34 zoning district as part of the Zone In initiative, appropriate design guidelines will be applied at that time. Staff supports the request for an unrestricted C-4 district with the understanding that the screening required by Section 3321.09 will need to be installed along the north and west property lines within nine months of the issuance of a Certificate of Occupancy for the intended use; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

3812 E. POWELL RD. (43035), being 1.49± acres located on the west side of East Powell Road, 320± feet east of Worthington Road, and being more particularly described as follows:

 

Parcel One:

Situated in the State of Ohio, County of Delaware and in the Township of Orange. Being part of Lot No. 16 of Section 4, Township 3, Range 18 United States Military Lands and being 1.0 acres of the 119.20 acre tract conveyed to John 0. and Josephine Clouse by deed of record in D.B. 261, Page 347, all references being to records of the Recorder's Office, Delaware County, Ohio, and being more particularly bounded and described as follows:

Beginning at a point in the centerline of the Scioto River, Powell and Alum Creek Road, that is located North 2 deg. 45' East, 98.10 feet from the southeasterly comer of said Clouse 119.20 acre tract or the southerly line of said Lot No. 16; thence North 83 deg. 09' West, 299.55 feet to a point; thence North 3 deg. 40' East, 146.25 feet to a point; thence along the southerly line of the H. William Dywer and Frank G. Kelling, Sr., 0.636 acre tract, South 83 deg. 09' East, 297.20 feet to a point in the centerline of said Scioto River, Powell and Alum Creek Road; thence along the centerline of said road, South 2 deg. 45' West, 146.4 feet to the place of beginning, containing 1.0 acres, more or less.

Situated in the State of Ohio, County of Delaware and in the Township of Orange. Being part of the Clouse Farm located in the South middle part of Lot No. 16, Section 4, Township 3, Range 18, United States Military Land and bounded and described as follows:

Beginning at a point in the Scioto River, Powell and Alum Creek Road (Road No. 14), said nail being located North 2 deg. 03' East, 244.5 feet from the intersection of the centerline of the said road with the southerly line of the said Lot No. 16; thence North 83 deg. 09' West (passing an iron pipe at 30.27 feet) 297.2 feet to an iron pipe; thence North 4 deg. 23' East, 51.82 feet to an iron pipe; thence along the southerly line of a sixty (60) foot proposed roadway, North 80 deg. 21' East (passing an iron pipe at 265.9 feet) 297.0 feet to a railroad spike in Road No. 14; thence along the said road and along a curve to the right with the chord bearing South O deg. 39' West, 130.75 feet to a nail at the northwest comer of a 1.237 acre tract owned by Joseph Green; thence continuing along the said road and along the west line of the said 1.237 acre tract, South 2 deg. 03' West, 6.15 feet to the place of beginning, containing 0.636 acres, more or less.

Being a parcel of land lying on the LEFT side of the centerline of survey for Gemini Parkway, being referenced to said centerline, unless otherwise noted and referenced to Powell Road, as shown on ODOT right of way plan DEL-GEMINI PKWY EXTENSION.

Beginning for reference at a 1-inch iron pipe found at the comer common to Farm Lots 14, 15, 16 and 17; thence South 86°42'49" East, along the line between Farm Lots 16 and 17, a distance of 4,063.84 feet to a Mag Nail found at an angle point in an Easterly line of a 90.848-acre tract as described in a deed to Polaris 91 LLC, of record in Official Record 1094, Page 959; thence North 00°25'44" East, along said Easterly line a distance of 97.51 feet to a Mag Nail found at the Southeasterly corner of said LO-acre tract, the True Place of Beginning being located 113.53 feet Left of station 112+63.25:

Thence North 78°02'38" East, along said Northerly and Southerly lines, a distance of 30.03 feet to a Mag Nail found in the old centerline of Powell Road located 101.19 feet Right of Powell Road station 419+60.6 l;

Thence along said centerline with the arc of a curve to the right having a radius of 636.62 feet, a central angle of 11°38'5T', an arc length of 129.44 feet, the chord of which bears South 03°43'12" East, a chord distance of 129.21 feet to a Mag Nail found at the point of tangency located 177.22 feet RIGHT of Powell Road station 42o+73.28;

Thence South 00°25'4411 West, continuing along said centerline, a distance of 153.13 feet the True Place of Beginning and containing 0.192 acre of land, 0.101 acre of said 1.0-acre tract (Delaware County Auditor's Parcel Number 31844104007000) of which the present road occupies 0.101 acre and 0.091 acre of said 0.636-acre tract (Delaware County Auditor's Parcel Number 31844104006000) of which the present road occupies 0.084 acre.

Bearings herein are based on the Ohio State Plane Coordinate System, North Zone, NAD 83 (2011) and OPS observations of the Delaware County Geodetic Control Monumentation.

Irons pins set consist of a 5/8-inch rebar, 30 inches long with an orange plastic cap stamped "IBI Group, S-6872/S-7740".
