Explanation
 
 
BACKGROUND:  Some lands adjacent to the Hoover Reservoir are presently being eroded and must be protected as soon as possible to prevent any future damage to the property. This project provides for the construction of protective measures to prevent any further erosion.
The procurement of this contract was conducted in accordance with Section 329.09.
 
Competitive bids were received and opened at the office of the Director of Public Utilities July 27, 2005.  Of the four (4) bids received, the lowest responsive,  responsible and best bidder was McDaniels Construction Corp., Inc.

EMERGENCY:  Emergency legislation is being requested to allow underwater work to take advantage of favorable water levels at Hoover Reservoir.
 
FISCAL IMPACT: This project is included in the 2005 CIB and $200,000 is budgeted.  The 2005 CIB is being amended and funds are being transferred to provide the additional funding.

WHEREAS, the Director of Public Utilities did receive and open bids on July 27, 2005 for the Hoover Reservoir Erosion Control - Improvement Number 36 for the Division of Water, Department of Public Utilities, and
 
WHEREAS, a satisfactory low bid has been received, and
 
WHEREAS, The control of shoreline erosion of the Hoover Reservoir is necessary to prevent loss of private property, and
 
WHEREAS, an emergency exists in the usual daily operations of the Division of Water, Department of Public Utilities in that it is immediately necessary to authorize the Director of Public Utilities to enter into a Contract with McDaniels Construction Corp., Inc., for the Hoover Reservoir Erosion Control - Improvement Number 36, for the Division of Water, to take advantage of favorable water levels at Hoover Reservoir for execution of the work and for the preservation of public health, peace, property and safety, now, therefore;
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1. That the Director of Public Utilities be and is hereby authorized to enter into a Contract with McDaniels Construction Corp., Inc., in the amount of $270,985.22 for the Hoover Reservoir Erosion Control - Improvement Number 36 for the Division of Water, Department of Public Utilities, Contract No. 1085 on the basis of the lowest responsive and responsible and best bid received on July 27, 2005.
 
Section 2.  That for the purpose of paying the cost thereof, the expenditure of $270,985.22 is hereby authorized from Waterworks Enlargement Voted 1991 Bonds Fund, Fund No. 606, Department of Public Utilities, Division of Water, Dept./Div No. 60-09, Object Level Three 6621, Project No. 690006 OCA Code 642900.
 
Section 3.  The City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project; that the project has been completed and the monies are no longer required for said project except that no transfer shall be so made from a project account funded by monies from more than one source.
 
Section 4.  The City Auditor is hereby authorized and directed to appropriate and transfer funds from within the Waterworks Enlargement Voted 1991 Bonds Fund, Fund No. 606, Department of Public Utilities, Division of Water, as follows:

Section 6.  That for reasons stated in the preamble, hereto, which is hereby made part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after approval if the Mayor neither approves nor vetoes the same.
