Council Variance Application:  CV22-114

 

APPLICANT:  Juliet Bullock Architects; c/o Juliet Bullock, Arch.; 4886 Olentangy Boulevard; Columbus, OH 43214. 

 

PROPOSED USE:  Residential development.

 

COLUMBUS SOUTH SIDE AREA COMMISSION RECOMMENDATION:  Approval.

                                                                                

CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The applicant has received a recommendation of approval from Staff and the Development Commission for a concurrent rezoning request to the R-4, Residential District (Ordinance #1065-2023; Z22-084). The requested Council variance proposes a four-unit dwelling with variances to reduce the building setback lines along both the East Kossuth Street and Ann Street frontages, and to reduce the maximum and minimum side yards. Staff supports the proposed variances because they will result in a residential development that is consistent with the development pattern of the neighborhood.

To grant a Variance from the provisions of Sections 3332.21, Building lines; 3332.25, Maximum side yards required; and 3332.26(C)(F), Minimum side yard permitted, of the Columbus City Codes; for the property located at 616 E. KOSSUTH ST. (43206), to permit reduced development standards for a four-unit dwelling in the R-4, Residential District (Council Variance #CV22-114).

 

Body

 

WHEREAS, by application #CV22-114, the owner of property at 616 E. KOSSUTH ST. (43206), is requesting a Council variance to permit reduced development standards for a four-unit dwelling in the R-4, Residential District; and

 

WHEREAS, Section 3332.21, Building lines, requires a minimum setback from the right-of-way line of 25 feet from the East Kossuth Street and Ann Street frontages, while the applicant proposes setbacks of a seven feet from East Kossuth Street, and ten feet from Ann Street; and

 

WHEREAS, Section 3332.25, Maximum side yards required, requires the sum of the widths of the side yards to equal or exceed 20 percent of the width of the lot, or 16 feet along East Kossuth Street and 11.12 feet along Ann Street, while the applicant proposes a total side yard of 15.34 feet along East Kossuth Street, and 10 feet along Ann Street; and

 

WHEREAS, Section 3332.26(C)(F), Minimum side yard permitted, requires a side yard of no less than five feet on a lot more than 40 feet wide, and that a side yard of no less than one-sixth of the height of the building or buildings over two and one-half stories in height, or 5.71 feet for a building with a height of 34.28 feet; while the applicant proposes reduced side yards of three feet along the north property line, and 5.34 feet along the west property line; and

 

WHEREAS, the Columbus South Side Area Commission recommends approval; and

 

WHEREAS, the City Departments recommend approval because the requested variances result in a residential development that is consistent with the existing development pattern of the neighborhood; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and a Certificate of Occupancy for the proposed use; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public roads, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 616 E. KOSSUTH ST. (43206), in using said property as desired, now therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance from the provisions of Sections 3332.21, Building lines; 3332.25, Maximum side yards required; and 3333.26(C)(F), Minimum side yard permitted, of the Columbus City Codes; is hereby granted for the property located at 616 E. KOSSUTH ST. (43206), insofar as said sections prohibit a reduced building line along East Kossuth Street from 25 feet to seven feet, and along Ann Street from 25 feet to 10 feet; a reduction in the maximum side yard from 16 feet to 15.34 feet along East Kossuth Street, and from 11.12 feet to 10 feet along Ann Street; and a reduction in the minimum side yard from 5.71 feet to 5.34 feet along the west property line, and to three feet along the north property line; said property being more particularly described as follows:

 

616 E. KOSSUTH ST. (43206), being 0.19± acres located at the northwest corner of East Kossuth Street and Ann Street, and being more particularly described as follows:

 

TRACT 1: SITUATED IN THE COUNTY OF FRANKLIN IN THE STATE OF OHIO AND IN THE CITY OF COLUMBUS; PARCEL NUMBER  010-001705,  PLAT BOOK 4, PAGE 328, LOT NUMBER 2 OF SAMUEL MCCLELLAND'S SUBDIVISION.  DESCRIBED AS FOLLOWS AS CONSISTING OF 0.186 ACRES AND BEING 145’ WIDE BY 55.9’ DEEP.

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is developed with those uses permitted in the R-4, Residential District.  

 

SECTION 3.  That this ordinance is further conditioned on the subject site being developed in general conformance with the site plan titled,PROPOSED SITE PLAN,” dated March 6, 2023, and signed by Juliet Bullock. The plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed. Any slight adjustments to the plans shall be subject to review and approval by the Director of the Department of Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.

 

SECTION 4.  That this ordinance is further conditioned on the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed use.

 

SECTION 5.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
