Title: To authorize and direct the Director of Recreation and Parks to enter into a lease agreement with the Actor's Summer Theater for the property located at 1000 City Park Drive, Columbus, Ohio 43206 for a term of one (1) year with an option to renew for an additional five (5) years, and to declare an emergency.
Explanation
 
Background:  This legislation will authorize the Director of Recreation and Parks to enter into a lease agreement with the Actor's Summer Theater for lease of  the Schiller Residence House, Schiller Ampitheater and temporary Concession Structure, located at 1000 City Park Drive, Columbus, Ohio, 43206.  Terms of the lease shall be for a period of one year and shall be automatically renewable for successive terms of one (1) year each up to a maximum of five (5) terms pending agreement by both parties. The Actor's Summer Theater has been performing theatrical productions at Schiller Park for over ten (10) years for the community, free of charge.  They utilize the Schiller Residence House for office and storage, the Schiller Ampitheater for productions and for storage of stage materials and the temporary concession structure to offer snacks and drinks to the public.  Actor's Summer Theater pays $1.00 per year for use of the Residence House in addition to obtaining the necessary permits from the Recreation and Parks Department for use of the Ampitheater and the concession structure.  Annual permit fees range from $1,000 to $1,200.  
 
Emergency action is requested so that the current agreement can be put under a lease for legal and liability purposes.

Title
 
To authorize and direct the Director of Recreation and Parks to enter into a lease agreement with the Actor's Summer Theater for the property located at 1000 City Park Drive, Columbus, Ohio 43206 for a term of one (1) year with an option to renew for an additional five (5) years, and to declare an emergency.
 
 
Body
 
WHEREAS, the City of Columbus owns certain real property commonly known as 1000 City Park Drive, Columbus, Ohio 43206; and
 
WHEREAS, on behalf of the City of Columbus, Ohio, the Director of Recreation and Parks desires to enter into a lease agreement with Actor's Summer Theater for a period of one (1) year with a five (5) year renewable option; and
 
WHEREAS, the Actor's Summer Theater has utilized the space at Schiller Park for over ten (10) years performing theatrical productions and providing entertainment and bringing a positive influence to the community at large; and
 
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department, in that is immediately necessary to authorize the Director to enter into a lease agreement with the Actor's Summer Theater thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Recreation and Parks Director is hereby authorized to execute those documents approved by the Department of Law, Division of Real Estate, necessary to enter into a lease agreement by and between the City of Columbus, Ohio and the Actor's Summer Theater for the property located at 1000 City Park Drive, Columbus, Ohio 43206.
 
Section 2.  That the terms and conditions of the lease shall be approved in form by the City Attorney's office and shall include the following:
 
a).     That the lease shall be for a period of one (1) year and shall be automatically renewable for successive terms of one (1) year each up to a maximum of five (5) terms.
b).     Such other terms and conditions as are required and/or approved by the City
         Attorney's office.
 
Section 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after is passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
