BACKGROUND
 
Need:  This legislation authorizes the Director of Public Utilities to enter into an agreement with Malcolm Pirnie, Inc., for professional engineering services for the Wastewater Treatment Facilities Upgrade, General Program--Overall Engineering Consultant (OEC) Services, Project 650360, for the Division of Sewerage and Drainage.  It amends the 2002 Capital Improvements Budget.  It also appropriates and transfers funds from the Sewerage System Reserve Fund to the 1991 Sanitary Bond Fund.
 
Procurement Information:  This procurement was conducted in accordance with the Request For Statement of Qualifications (RFSQ) process set forth in Section 329.13, Columbus City Codes, 1959.  The process was conducted as follows:
 
1.  Written notice of need was made to City Council on February 13, 2002.
 
2.  The RFSQ was published in the "City Bulletin" on February 23 and March 2, 2002.
 
3.  All Offerors were required to obtain an Offeror's Information packet by March 15, 2002.
 
4.  Statements of Qualifications (SOQs) were received on April 8, 2002 from four firms; no MBE or FBE firms submitted an SOQ.
                       
5.  The Division's Evaluation Committee recommended three firms for further consideration.  On June 3, 2002 the firms were notified in writing of this action and were requested to submit a technical proposal.  The three firms were:
 
BBS Corporation/Brown and Caldwell
Camp Dresser & McKee
Malcolm Pirnie, Inc.
 
6.  Proposals from the three firms were received on July 12, 2002.
 
7.  The evaluation and final ranking of the firms were based upon the quality and feasibility of the proposals.
 
8.  On July 26, 2002 the Evaluation Committee reported its recommendation for selection to the Director.  All three firms were notified in writing of the final selection.
 
9.  Subsequent discussions and negotiations with the selected firm have resulted in further refinement of the scope of the work and results in this ordinance.  The name and address of the selected firm is:

Emergency Designation:  It is requested that this ordinance be designated an emergency so that the engineering tasks funded by this legislation can proceed immediately in order to coordinate with work being performed under the Sanitary Sewer Overflow Elimination/Consent Order program.  In addition, due to seasonal constraints, the water quality analysis work under this project needs to begin immediately.
 
FISCAL IMPACT:
 
Budgeted Amount:  There will be sufficient authority in the 2002 Capital Improvements Budget for this expenditure, upon passage of this ordinance.  
 
There will be sufficient funds in the appropriate project account, upon passage of this ordinance, transferring a total amount of $3,825,000.00 from the Sewerage System Reserve Fund.  The current funding source is an interim financing step.  This project is not eligible for a WPCLF loan.
 
Contract Amount:  $3,825,000.00.  This contract is proposed as a six-year undertaking, with approximately annual incremental modifications to supply funding.  The contract will be budgeted annually in the Division's Capital Improvements Plan.  The contract provides overall engineering coordination, general studies to determine capital improvement needs in response to regulatory changes, updating the Division's General Engineering Report, and other general engineering matters in the treatment plants' capital improvements program.
 
PROJECT LOCATION:  This project involves issues of a general nature and deals with the Division's entire citywide facilities and operations; it is not area specific.

($3,825,000.00)
 
Body
 
WHEREAS, the procurement was conducted in accordance with the Request For Statement of Qualifications (RFSQ) process set forth in Section 329.13, Columbus City Codes, 1959, and the Division's Evaluation Committee recommended three firms for further consideration, and Malcolm Pirnie, Inc. was selected from among the three firms; and
 
WHEREAS, it is immediately necessary to amend the 2002 Capital Improvements Budget to provide sufficient authority for increasing a capital project account; and
 
WHEREAS, it is immediately necessary to both appropriate funds from the Sewerage System Reserve Fund and transfer said funds into the 1991 Sanitary Bond Fund; and
 
WHEREAS, the funding method for this expenditure is a temporary measure until such time as the City sells notes or bonds for the above stated purpose and reimburses the Sewerage System Reserve Fund; and
 
WHEREAS, the aggregate principal amount of obligations which the City will issue to finance this project is presently expected not to exceed $3,825,000.00; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to enter into an agreement with an accredited firm for professional engineering services for the Wastewater Treatment Facilities Upgrade, General Program-Overall Engineering Consultant (OEC) Services, Project 650360, at the earliest practicable date for the immediate preservation of the public health, peace, property and safety; Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities be, and hereby is, authorized to enter into an agreement with Malcolm Pirnie, Inc., 1900 Polaris Parkway, Suite 200, Columbus, Ohio 43240, for professional engineering services for the Wastewater Treatment Facilities Upgrade, General Program-Overall Engineering Consultant (OEC) Services, Project 650360, in accordance with the terms and conditions as shown in the agreement on file in the office of the Division of Sewerage and Drainage.
 
SECTION 2.  That the said professional engineering services firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
 
SECTION 3.  That the 2002 Capital Improvements Budget Ordinance No. 1674-02 is hereby amended and increased as follows, to provide sufficient budget authority for the execution of the professional engineering services agreement stated in Section 1.

SECTION 4.  That from the unappropriated monies in the Sewerage System Reserve Fund, Fund 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2003, the sum of $3,825,000.00 is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05, Object Level One 10, Object Level Three 5502, OCA 901654.
 
SECTION 5.  That the City Auditor is hereby authorized to transfer said funds to the 1991 Sanitary Bond Fund, Fund 664, for the Wastewater Treatment Facilities Upgrade, General Program-Overall Engineering Consultant (OEC) Services, Project 650360, at such time as is deemed necessary by him, and to expend said funds or so much thereof as may be necessary.
 
SECTION 6.  That $3,8250,000.00 is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05, 1991 Sanitary Bond Fund, Fund 664, Project 650360, OCA 650360, Object Level Three 6678, for the Wastewater Treatment Facilities Upgrade, General Program-Overall Engineering Consultant (OEC) Services.
 
SECTION 7.  That upon obtaining other funds for the purpose of funding wastewater treatment facilities capital improvements work, the City Auditor is hereby authorized to repay the Sewerage System Reserve Fund the amount transferred under Section 5. above; and said funds are hereby deemed appropriated for such purpose.
 
SECTION 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with expenditure of the funds transferred under Section 5. above.
 
SECTION 9.  That the City intends that this ordinance constitutes an "official intent" for purposes of Section 1.150-2(e) of the Treasury Regulations promulgated pursuant to the Internal Code of 1986, as amended.
 
SECTION 10.  That the expenditure of $3,825,000.00, or as much thereof as may be needed, be and the same hereby is authorized from the 1991 Sanitary Bond Fund, Fund 664, Division 60-05, Division of Sewerage and Drainage, Project 650360, OCA 650360, Object Level Three 6678, to pay the cost of this contract.
 
SECTION 11.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
