Background
 
A.)  Need:
The purpose of this legislation is to authorize the Director of Public Utilities to enter into an agreement with Corrosion Probe Inc. to provide Quality Control Inspection Services for Improvements to Existing Linabond Lining System in the Big Walnut Augmentation Rickenbacker Interceptor (BWARI) for the Department of Public Utilities.
 
The agreement will provide the Department of Public Utilities with a complete analysis and recommendations in regards to the improvements necessary to place the tunnel in full service. The company will conduct thorough inspections of the tunnel for the Department of Public Utilities and will prepare recommendations for the department.
 
Waiver of competitive bidding provisions of City Code is being requested.  Selection of Corrosion Probe Inc. was made in consultation with the City Attorney's Office due to the fact that the recommended firm has particular expertise in doing this type of analysis.  The firm was selected by the City Attorney's Office to provide expert testimony during the Disputes Resolution Board's hearing.  The disputes are not yet resolved and additional services are being provided for detailed investigations and quality control.
 
B.)  Fiscal Impact: $200,000.00 is needed for this contact and adequate funding remains in the project under the Sanitary Sewer Revenue Bonds Fund.
 
C.)  Contract Compliance No.: 061123092 (MAJ) (Expiration: 10/24/2010)
 
D.)  Emergency Designation:
Emergency action of City Council is requested to allow this agreement to be effective prior to the end of 2008.
 
 
Title

Body
 
WHEREAS, the Department of Public Utilities has a need to conduct Quality Control Inspection Services for Improvements to the Existing Linabond Lining System for the BWARI project; and
 
WHEREAS, the agreement will provide the Department of Public Utilities with a complete analysis and recommendations in regards to improvements necessary to place the tunnel in full service; and
 
WHEREAS, waiver of competitive bidding provisions of City Code is being requested; and
 
WHEREAS, the selection of Corrosion Probe Inc., was made by the Department of Public Utilities in consultation with the City Attorney's Office.  The recommended firm has particular expertise in doing this type of analysis; and
 
WHEREAS, it is necessary for City Council to authorize the expenditure of funds from the Sanitary Sewer Revenue Bonds Fund; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary for this Council to authorize the Director of Public Utilities to execute an agreement with Corrosion Probe Inc. for Quality Control Inspection Services, in connection with the BWARI project prior to the end of 2008; for the immediate preservation of the public health, peace, property, and safety; Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Director of Public Utilities be, and hereby is, authorized to enter into an agreement with Corrosion Probe Inc., 12 Industrial Park Rd., PO BOX 178, Centerbrook, CT, 06409, for Quality Control Inspection Services in relation to the BWARI project, in accordance with the terms and conditions as shown in the agreement on file in the office of the Division of Sewerage and Drainage.
 
Section 2.  That for the purpose of paying the cost of the agreement, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:  Division 60-05; Fund 665; BWARI project, Project No. 650491.1; Object Level 6630; OCA Code 665491; Amount $200,000.00
 
Section 3. That in accordance with Section 329.27 of the Columbus City Codes, the Columbus City Council finds it in the best interest of the City of Columbus to waive formal competitive bidding requirements as they pertain to the action authorized in SECTION 1 of this ordinance and that Sections 329.06 and 329.07 of the Columbus City Codes are hereby waived.
 
Section 4.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 5.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
