Explanation
The Mid-Ohio Regional Planning Commission (MORPC) is accepting Ohio Public Works Commission (OPWC) Round 22 applications for the State Capital Improvements Program (SCIP) through September 10, 2007.  OPWC requires that a designated official be authorized to submit said applications and execute project agreements for approved projects.  MORPC serves in a staff support capacity to the District Three (Franklin County) Public Works Integrating Committee.
 
OPWC requires legislation which will authorize the Public Utilities Director to submit applications for financial assistance and to execute project agreements for approved projects.  Additionally, the OPWC SCIP program will award no interest loans, grants, and loan assistance in the form of interest payments to successful program participants.  Therefore, the applications and subsequent program agreements may also require approval from the Finance and Management Director and City Auditor to sign for funding use certifications, local match availability, and to certify loan portion repayment.
 
Fiscal Impact:  Approval of this legislation will provide an opportunity to secure loans, grants, and credit enhancement funds for various Division of Sewerage and Drainage projects.  The approximate available funding to the District Three Public Works Integrating Committee for SCIP is $12.260 million.  Funds for the City's share of these programs are included in the 2007 to 2011 Capital Improvements Plan.  No financial participation is required at this time.  City funds will be approved in the form of design contracts and/or construction contracts that will be submitted for Council's approval.  City project funds and City matching funds may be required depending on the category of the approved funding program.
 
Title
To authorize the Director of Public Utilities to submit applications for grants, loans, and loan assistance for Round 22 of the State Capital Improvements Program to the District Three Public Works Integrating Committee and the Ohio Public Works Commission; and to execute project agreements for approved projects for the Division of Sewerage and Drainage on behalf of the City of Columbus; and to authorize the Finance and Management Director and City Auditor, appropriate, to sign for funding use certification, local match availability, and to certify loan portion repayment and to declare an emergency.  
 
Body
WHEREAS, pursuant to Article VIII, Section 2K of the Ohio Constitution, the State of Ohio is authorized to issue bonds and other obligations of the state for the purpose of financing public infrastructure capital improvements of political subdivisions as designated by law; and
 
WHEREAS, pursuant to Section 164.06 of the Ohio Revised Code, the District Three Public Works Integrating Committee has been created to accept, evaluate and recommend applications for state financing of capital infrastructure improvement projects of political subdivisions in Franklin County; and
 
WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Ohio Public Works Commission has been created to accept and approve applications for state financing of capital infrastructure improvement projects of political subdivisions in Franklin County; and
 
WHEREAS, the City of Columbus Department of Public Utilities has conducted a capital inventory and needs assessment and has determined that it is necessary to submit applications for financial assistance for capital infrastructure improvement projects;  and  NOW, THEREFORE:
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Utilities in that it is immediately necessary to pass this ordinance as an emergency measure because of the need to complete the design and construction projects on time; for the preservation of the public health, peace, property, safety, and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Utilities be, and hereby is, authorized to submit applications for grants,  loans, and loan assistance to the District Three Public Works Integrating Committee and the Ohio Public Works Commission for the following capital infrastructure improvement projects:
 
1.   CIP No. 650255, Southerly Wastewater Treatment Plant Skimmings Concentrator System Improvements
2.   CIP No. 650618, Chestnut Street Combined Sewer Rehabilitation
3.   CIP No. 650620, Lockbourne Road Area Assessment Sewer
4.   CIP No. 650739, Petzinger Road Area Assessment Sewer
5.  CIP No. 690404, Livingston Avenue 24- Inch Water Main Improvement
6.  CIP No. 690403, Champion Avenue 24-Inch Water Main
7.  CIP No. 690236, Far East Water Line Improvements, Part 2
8.  CIP No. 610711, ST-28 Williams Road Pump Station Replacement
9.  CIP No. 610937, Lockbourne Road Drainage Improvements
 
Section 2.  The Director of Public Utilities is further authorized to enter into any agreements as may be necessary and appropriate for obtaining this financial assistance in conjunction with the recommendations of the Administrators of the Division of Sewerage and Drainage and the Division of Power & Water, and approved as to form by the City Attorney; and to authorize the Finance and Management Director and City Auditor, as appropriate, to approve and sign for funding use certification, local match availability, and to certify loan project repayment agreements.
 
SECTION 3.  That project additions and substitutions are at the discretion of the Director of Public Utilities based upon the feasibility of the applications being approved through the scoring process.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
