Explanation
Background:  The City of Columbus, Transportation Division, is engaged in the Miscellaneous Intersections Improvement Group 10 project that includes the intersections of Trabue and Walcutt Roads and Hudson and North High Streets.  Improvements will be made to turning radii, handicapped access, pavement, drainage structures, traffic control devises and street lighting at various intersections throughout City.  The City originally began acquisition of right-of-way for the Group 10 intersections in 1999.  As a result of updated design standards and after more in-depth plan review it has been determined that additional right-of-way will be required before construction of the proposed improvements can begin.  Preliminary acquisition cost estimates indicate $30,000.00 will be required for acquisition-related activities, including title and closing costs, appraisal fees, other staff costs, and acquisition of fee simple title and lesser interests in addition to the recently identified additional property needed for this project.  This legislation authorizes the City Attorney to expend $30,000.00 for this project.
 
Fiscal Impact:  The Transportation Division budgeted $2.14 million in the 2004 Capital Improvements Budget (CIB) for Roadway Improvements.  All of the funds from the July 2004 bond sale for Roadway Improvements have either been expended or encumbered.  This ordinance authorizes acquisition-related expenses of $30,000.00 for the Group 10 Intersection Improvement.  Therefore, funds for this ordinance must be transferred within the Transportation Division's 1995, 1999 Voted Streets and Highways Fund from the Krumm Park project to Roadway Improvements.  
 
Emergency action is requested to allow right-of-way acquisition-related activities to be resumed by the City Attorney's Office, Real Estate Division, as soon as possible.

Body
WHEREAS, the City of Columbus is engaged in the Miscellaneous Intersections Improvement Group 10 project; and
 
WHEREAS, improvements will be made to turning radii, pavement, handicapped access, drainage structures, traffic control devises and street lighting at various intersections throughout City; and
WHEREAS, the City originally began acquisition of right-of-way for the Group 10 intersections in 1999; and
 
WHEREAS, as a result of updated design standards and after more in depth plan review it has been determined that additional right-of-way will be required before construction of the proposed improvements can begin; and
 
WHEREAS, preliminary acquisition cost estimates indicate $30,000.00 will be required for acquisition related activities, including title and closing costs, appraisal fees, other staff costs and acquisition of fee simple title and lesser interests in and for additional property needed for this project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney to expend the funds necessary to hire professional services and begin acquisition of necessary additional right-of-way so that construction of the improvements at the intersections of Trabue and Walcutt Roads and Hudson and High Streets can begin without further delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the transfer of $30,000.00 between projects within Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, be and hereby is authorized as follows:

SECTION 2.  That the City Attorney be and hereby is authorized to begin the acquisition-related activities necessary to acquire fee simple title and lesser interests in and to those parcels needed for the Miscellaneous Intersections Improvement Group 10 project and to expend those funds required to pay said related acquisition costs.
 
SECTION 3.  That for the purpose of paying for said costs the City Attorney's Office, Real Estate Division be and hereby is authorized to expend $30,000.00 or so much thereof as may be necessary from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department 59-09; Transportation Division, Object Level One Code 06, Object Level Three Code 6601, OCA Code 644385 and Project 530161.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
