Explanation
 
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into an agreement with CDM Smith, Inc., for professional engineering services for the Watershed Master Planning Project, in an amount up to $904,750.00, for the Division of Water.
 
The Department of Public Utilities' Division of Water supplies clean, safe drinking water to over one million residents of central Ohio and has long had an active watershed protection program.  The Division desires an evaluation of the risks to its drinking water sources, and the development of short and long term action plans to cost-effectively mitigate those risks.
 
This project will provide master planning for watershed management and source water protection operations.  It will provide strategic direction and recommend best practices and actions to safeguard the environmental health and viability of Columbus's raw water supplies and associated watersheds.
 
2. ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT: Activities and land-use within the watersheds directly affect the quality of the raw drinking water source.  This project will evaluate current and future pollutants of concern and recommend best practices for the long-term management of quality source water supplies.  It will also include evaluation of specific pollutant impacts within defined watershed areas, consider flow, stormwater and land use characteristics pertaining to contaminant sources, and recommend strategy for communication and partnership to sustain quality reservoirs, healthy riparian corridors, and effective land-management for water resource protection.
 
3. BID INFORMATION:  The selection of the firm providing the professional engineering services has been performed in accordance with the procedures set forth in Columbus City Code, Section 329.14, "Awarding professional service contracts through requests for proposals."  The evaluation criteria for this contract included:  1. proposal quality, 2. experience of team, 3. ability to perform expeditiously, 4. past performance, 5. environmentally preferable offeror, and 6. local workforce.
 
Requests for Proposals (RFP's) were received on December 12, 2013 from CDM Smith, Inc., ARCADIS US, Inc., and Brown and Caldwell, Ohio.
 
An evaluation committee reviewed the proposals and scored them based on the criteria mentioned above.  The Department of Public Utilities recommends that the contract be awarded to CDM Smith, Inc.
 
The Contract Compliance Number for CDM Smith, Inc. is 04-2473650 (expires 5/23/14, MAJ).  
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against CDM Smith, Inc.
 
4. FISCAL IMPACT: A transfer of funds within the Water Works Enlargement Voted Bonds Fund will be necessary, as well as an amendment to the 2014 Capital Improvements Budget.

WHEREAS, the Department of Public Utilities' Division of Water supplies clean, safe drinking water to over one million residents of Central Ohio; and  
 
WHEREAS, the majority of the water supply for the Division is the several reservoirs owned and operated by the Division; and
 
WHEREAS, the Division has long had an active watershed protection program, which program the Division would like to have updated and verified; and
 
WHEREAS, the Division desires and evaluation of the risks to its drinking water sources, and the development of short and long term action plans to cost-effectively mitigate those risks; and
 
WHEREAS, the Division desires an evaluation of its watershed protection activities, including the land stewardship program it operates at its reservoirs; and
 
WHEREAS, the Department had solicited requests for proposals pursuant to the requirements of city code section 329.14; and
 
WHEREAS, upon evaluation of all proposals and interviews, it was determined that the proposal submitted by CDM Smith would best meet the needs of the Department of Public Utilities for the Watershed Master Planning Project; and
 
WHEREAS, it is necessary for this Council to authorize the transfer and expenditure of funds within the Water Works Enlargement Voted Bonds Fund, for the Division of Water; and  
 
WHEREAS, it is necessary to authorize an amendment to the 2014 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and
 
WHEREAS, it has become necessary in the usual daily operation of the Division of Water, Department of Public Utilities, to authorize the Director of Public Utilities to enter into a professional engineering services agreement with CDM Smith, Inc. for the Watershed Master Planning Project, for the preservation of the public health, peace, property and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities be and hereby is authorized to enter into a professional engineering services agreement for the Watershed Master Planning Project with the best, most responsive, and responsible bidder, CDM Smith, Inc., 8800 Lyra Drive, Suite 500, Columbus, Ohio 43240; for an expenditure up to $904,750.00; in accordance with the terms and conditions of the contract on file in the Office of the Division of Water.
 
SECTION 2.  That the City Auditor is hereby authorized to transfer $904,750.00 within the Department of Public Utilities, Division of Water, Water Works Enlargement Voted Bonds Fund, Fund No. 606, Dept/Div. No. 60-09, Object Level Three 6677, as follows:

SECTION 4.  That an expenditure up to $904,750.00 is hereby authorized for the Watershed Master Planning Project within the Water Works Enlargement Voted Bonds Fund, Fund No. 606, Division 60-09, Project No. 690544-100000 (carryover), OCA Code 606544, Object Level Three 6677.
 
SECTION 5.  That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 6.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 7.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 9.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
