Explanation
BACKGROUND:    This legislation authorizes the Director of Public Safety to modify the existing contract with MaxResources dba CleanScene BioRecovery Services for biohazardous waste collection and disposal services for the Division of Fire.  During emergency medical runs and transports, the Division of Fire uses a variety of miscellaneous medical supplies, such as needles, gauze, bandages, etc., to treat patients in need.  The resulting waste is biohazardous in nature, and is safely contained until it can be collected and disposed of properly.  The Division of Fire contracts for the collection and removal of this biohazardous waste from it's fire stations on an as needed basis, and is in need to modify and extend the current contract with MaxResources dba CleanScene BioRecovery Services so that these services can continue.  Due to the hazardous nature of the medical waste being collected and disposed, the competitive bidding requirements of City of Columbus Code Section 329.06 are being waived for this purchase, to afford the Division of Fire the time necessary to prepare bid specifications and solicit bids for these services.

Contract Compliance:         MaxResources dba CleanScene BioRecovery Services, a Minority vendor ~ 421708453 exp. 2/15/2014
Emergency Designation:      Emergency action is requested so that the removal and disposal of biohazardous waste can continue without interruption.
FISCAL IMPACT:   Funds are available in the Division of Fire's General Fund budget for these services.  Year to date the Division of Fire has spent approximately $16,000.00 for these services.  The Division of Fire spent approximately $20,000.00 for these services in 2011 and 2010.
Body
WHEREAS, the Division of Fire contracts for the collection and disposal of biohazardous waste from it's fire stations; and
WHEREAS, there is a need to waive competitive bidding and modify and increase the current contract so that these services can continue uninterrupted; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Fire, Department of Public Safety, in that it is immediately necessary to modify and extend the current contract with CleanScene BioRecovery Services, thereby preserving the public health, peace, property, safety and welfare; Now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Public Safety is hereby authorized to modify and extend the existing contract with MaxResources dba CleanScene BioRecovery Services for biohazardous waste collection and disposal services for the Division of Fire.
SECTION 2.  That the expenditure of $15,000.00, or so much thereof as may be necessary, is hereby authorized to be expended from the General Fund 010, Department of Public Safety 30, Division of Fire 30-04, OCA 301531, Object Level Three Code 3412.
SECTION 3. This Council finds it is in the best interest of the City of Columbus to waive the provisions of Section 329.06 of the Columbus City Codes to permit the aforementioned purchase.
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
