Explanation
1. BACKGROUND:
A. Need. This legislation authorizes the Director of Public Utilities to modify the professional engineering services contract with Evans, Mechwart, Hambleton & Tilton, Inc. (EMH&T), for the Bliss Run Trunk Sewer Improvements, Phase 3 project. The modification amount requested under this ordinance is $99,450.00. The contract total including this modification is $612,964.00. These additional monies will fund the costs of the continuation of the professional engineering (construction administration) services performed on the project. The construction contractor was unable to complete construction work within the original Contract timeframe due to a variety of reasons. The approved Contract completion date for the Construction Contractor, including all approved extensions, was December 3, 2007. The Contractor requested an extension of the Contract with a new contract completion date of May 1, 2008, which would also be for engineering services. Due to the complex and comprehensive nature of this project, this additional work could not be foreseen, and it is not practical or feasible to undertake a new procurement to deliver these services.

2. FISCAL IMPACT:
There is sufficient cash and authority within the Storm Sewer Bond Fund for this modification.

(EMH&T) for the Bliss Run Trunk Sewer Improvements, Phase 3 project; to authorize the expenditure of $99,450.00 within the Storm Sewer Bond Fund for the Division of Sewerage and Drainage. WHEREAS, Contract No. EL006025 was authorized by Ordinance No. 0367-2006, as passed by Columbus City Council on March 13, 2006 for purposes of authorizing the Director of Public Utilities to enter into contract with EMH&T for the purpose of providing professional engineering services during construction for the Bliss Run Trunk Sewer Improvements, Phase 3 project, CIP 610923; and
WHEREAS, it is necessary to modify this contract to provide funding for needed additions to the contract work which exceeds the available contingency amounts provided in the contract, pursuant to completion of the work; and
WHEREAS, it is necessary for City Council to authorize the expenditure of funds from the Storm Sewer Bond Fund; and
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to modify the construction contract for the Bliss Run Trunk Sewer Improvements, Phase 3 project, at the earliest practicable date; Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. EL006025 with EMH&T, 5500 New Albany Road, Columbus, Ohio, 43054, for professional engineering services for the Bliss Run Trunk Sewer Improvements, Phase 3 project, in order to provide for additional work, in accordance with the terms and conditions as shown in the Modification on file in the office of the Division of Sewerage and Drainage.
Section 2. That for the purpose of paying the cost of the professional engineering services contract modification, the appropriation and following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows: Division 60-15; Fund 685; Bliss Run Trunk Sewer Improvements, Phase 3, Project No. 610923; Object Level 3 6682; OCA Code 685923; Amount $99,450.00.
Section 3. That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
Section 4. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
Section 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
Section 6. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
