Explanation
Background:
The Music in the Air program began in 1973 and has had an agreement with the IATSE (International Alliance of Theatrical Stage Employees) and Moving Picture Machine Operators Local No. 12 stagehands union every year since then to provide stagehand services. IATSE created a separate business entity to process payroll for union members and payment for stagehands services has been directed to TPSCO since 2006. This ordinance will enable the Director of Recreation and Parks to enter into a contract with the IATSE Local No. 12 for stagehand services for Music In the Air events in 2008 and with the IATSE payroll company, Theatrical Payroll Services of Central Ohio (TPSCO) to enable payment of the IATSE stagehands. IATSE will provide stagehands on an as-needed basis for technical services. The union guarantees that trained personnel will be available according to the schedule set forth by the Department. These individuals must be specifically trained and remain constant as they are operating and responsible for city equipment within city facilities and park property.
Since hourly labor rates are carried out by negotiations with the Union and accepted through a vote by the Union membership, we are requesting the waiver of the formal bidding provisions of the Columbus City Codes to enter into a contract with IATSE and TPSCO.

Fiscal Impact:
$25,000.00 is required and budgeted to meet the financial obligation of this contract.
$17,836.96 was spent in 2006 and $25,000.00 was spent in 2007 for these services.

WHEREAS, it is in the best interest of the City of Columbus to waive the competitive bidding provisions of the Columbus City Code 329.06(b) and contract with IATSE Local No. 12 (International Alliance of Theatrical Stage Employees and Motion Picture Operators) for professional services in conjunction with Music In the Air events in 2008, and with the IATSE payroll company, Theatrical Payroll Services of Central Ohio (TPSCO); and
WHEREAS, the Recreation and Parks Department has had an agreement with IATSE since 1973 to provide stagehand services and the union members are specifically skilled and trained in order to operate city equipment within city parks and facilities ; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into said contract in order to allow stagehands sufficient time to perform necessary equipment preparation and maintenance prior to performances beginning in June; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That this Council finds it in the best interest of the City of Columbus to waive the provisions of competitive bidding for professional services in conjunction with the 2008 Music In the Air events, and does hereby waive Section 329.06(b) of the Columbus City Codes.
SECTION 2. That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with IATSE Local No. 12 (International Alliance of Theatrical Stage Employees and Motion Picture Operators) for professional services in conjunction with Music In the Air events in 2008, and with the IATSE payroll company, Theatrical Payroll Services of Central Ohio (TPSCO).
SECTION 3. That the expenditure of $25,000.00, or so much thereof as may be necessary, be and is hereby authorized from the Recreation and Parks Operating Fund No. 285; Department No. 51-01; OCA Code 510685; and Object Level 3 3336, to pay the cost thereof.
SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
