Council Variance Amendment CV01-054A
 
Ordinance # 0172-02, passed February 25, 2002, granted a Council variance (CV01-054) to property located at 1160 Steelwood Avenue to allow a university athletic team practice facility in the M-2, Manufacturing District.  Five conditions were established for the ordinance, including provisions that the facility would not be available for public use, and that no public or intercollegiate athletic competitions would be permitted at the facility.  The applicant has determined that due to NCAA rules and regulations imposed upon them, the facility must legally be open to the public for rental. This legislation amends Ordinance #0172-02 by revising the conditions listed in Section 3 in order for the facility to comply with NCAA rules and regulations.  All other conditions of Ordinance #0172-02 remain unchanged by this amendment.

To amend Ordinance #0172-02, passed February 25, 2002 (CV01-054), for the property located at 1160 STEELWOOD AVENUE (43212), by repealing Section 3 in its entirety and passing a revised Section 3  to permit public use and intercollegiate events in a university athletic team practice facility (CV01-054A).

WHEREAS, Ordinance #0172-02, passed February 25, 2002 (CV01-054), allowed a university athletic team practice facility at 1160 STEELWOOD AVENUE (43212) in the M-2, Manufacturing District; and
 
WHEREAS, this ordinance will amend Ordinance # 0172-02 by revising the conditions of the ordinance in order for the facility to comply with NCAA rules and regulations; and
 
WHEREAS, all other conditions contained in Ordinance #0172-02 are unchanged by this ordinance and will remain in effect, now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the existing Section 3 of Ordinance #0172-02, passed February 25, 2002 (CV01-054), be hereby repealed and replaced with a new Section 3 reading as follows:
 
SECTION 3.  That this ordinance is further conditioned on the following:
 
a.      A minimum of 68 parking spaces shall be provided on site, which includes existing parking spaces and 18 new on-site parking spaces.
 
      b.      A bicycle rack shall be provided on-site.
 
c.      The university athletic team practice facility shall be under the supervision, control and direction of the university at all times.
 
      d.      The university athletic team practice facility shall not be open to the   
                                public for commercial athletic training/exercise purposes.
 
      e.      No public and/or intercollegiate athletic competitions shall be held
                                at the university athletic team practice facility.
 
d.      The university athletic team practice facility shall be made available to the general public for rental and use of the facility and certain equipment located within the facility, subject to the renters' agreement to and compliance with any rental fees, insurance requirements, limitations regarding group size and/or use of the areas and/or equipment within the facility, all of which may be imposed by the University and disclosed in writing to all prospective renters.  Any agreement by the University to rent the facilities to the general public will be subject to the above restrictions and limitations, as well as availability of the facility on dates and times requested by the prospective renter.   This availability of the facility for use by the general public shall not preclude the University from restricting admittance of the general public during times of athletic team practices, for purposes of spectating or viewing such practices, so as not to disturb the athletic teams' scheduled and structured practice regimens.
 
 
SECTION 2.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
