Council Variance Application:  CV25-113

 

APPLICANT:  Ebony Hampton; 2286 Laurelwood Drive; Columbus, OH 43229.

 

PROPOSED USE:  Rooming house.

 

MIDEAST AREA COMMISSION RECOMMENDATION:  Approval.

                                                                               

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The site is developed with a two-unit dwelling in the R-4, Residential District. The requested Council variance will allow the existing dwelling to be converted into a rooming house with up to eight occupants. A Council variance is required because the R-4 district does not allow rooming houses. A variance to not provide parking lot screening is also included in the request. The proposed use will provide a short-term housing option for individuals utilizing the nearby airport or for working at other job centers in the surrounding area. Although there is no Council adopted land use plan for this location, the use is consistent with the mix of residential uses that are allowed by the R-4 district, and will not introduce an incompatible use to the area. Staff notes that a license is required by the Division of Code Enforcement to operate a rooming house in the City of Columbus.

To grant a Variance from the provisions of Sections 3332.039, R-4, residential district; and 3312.21(D), Landscaping and screening, of the Columbus City Codes; for the property located at 128-130 N. HAMPTON RD. (43213), to allow a rooming house with no parking lot screening in the R-4, Residential District (Council Variance #CV25-113).

 

Body

 

WHEREAS, by application #CV25-113, the owner of the property at 128-130 N. HAMPTON RD. (43213), is requesting a Variance to allow a rooming house with no parking lot screening in the R-4, Residential District; and

 

WHEREAS, Section 3332.039, R-4, residential district, does not allow rooming houses, while the applicant proposes to convert an existing two-unit dwelling into a rooming house with up to eight occupants; and

 

WHEREAS, Section 3312.21(D), Landscaping and screening, requires parking lot screening for parking lots within 80 feet of residentially zoned property, while the applicant proposes no screening; and

 

WHEREAS, the Mideast Area Commission recommends approval; and

 

WHEREAS, City Departments recommend approval of the proposed use as it will provide a short-term housing option that is consistent with the mix of residential uses that are allowed in the R-4 district, and will not introduce an incompatible use to the area; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits, licenses, and a Certificate of Occupancy for the proposed use; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

  

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 128-130 N. HAMPTON RD. (43213), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance is hereby granted from the provisions of Sections 3332.039, R-4, residential district; and 3312.21(D), Landscaping and screening, of the Columbus City Codes, for the property located at 128-130 N. HAMPTON RD. (43213), insofar as said sections prohibit a rooming house with up to eight occupants in the R-4, Residential District with no parking lot screening; said property being more particularly described as follows:

 

128-130 N. HAMPTON RD. (43213), being 0.19± acres located at the southeast corner of North Hampton Road and Maryland Avenue, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin, and City of Columbus:

 

Being Lot Number Eighty-Nine (89) of BROADLAND PLACE ADDITION, as the same is numbered and delineated upon the recorded plat thereof, of record in Plat Book 19, Page 39, Recorder’s Office, Franklin County, Ohio.

 

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a rooming house with up to eight occupants, or those uses allowed in the R-4, Residential District.

 

SECTION 3.  That this ordinance is further conditioned on the applicant obtaining all applicable permits, licenses, and a Certificate of Occupancy for the proposed use.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
