Explanation
 
 
1.      BACKGROUND:
 
A.      Need.  This legislation authorizes the Director of Public Utilities to enter into a professional engineering services agreement with Camp, Dresser, and McKee, Inc. for the Wastewater Treatment Facilities Instrumentation and Control (I&C) System Upgrade, Facilities Integration and Support Services project for the Division of Sewerage and Drainage. The Division has determined that these services cannot be performed by City personnel at this time, and has planned for the procurement of these services on a routine basis.
 
This contract will provide a consultant that is the sole integrator of new CIP projects, constructed through 2012, into the existing DOSD Plant Wide Process Control System (PWPCS) at the two wastewater treatment facilities and the Sewer Maintenance and Operations Center (SMOC). The contract is for a duration of five (5) years and shall be funded by incremental appropriation through the use of modifications.
 
As directed by the City, the integration consultant will assist and train DOSD staff with all issues associated with the PWPCS with the ultimate goal in mind of the City staff being self reliant to handle all PWPCS issues by the end of this contract. The consultant will assist City staff with such PWPCS items as integration, programming, management, troubleshooting and repairs, training and hardware, and software upgrades.
 
B.      Procurement Information:  This procurement was conducted in accordance with the Request For Proposals (RFP) process set forth in Section 329.14, Columbus City Codes, 1959.  The process was conducted as follows:
1.  Written notice of need was made to City Council on November 6, 2007.
2.  The RFP was advertised on the City web site beginning on
    November 11, 2007.
3.  All Offeror's were required to obtain an Offeror's Information packet
    by December 11, 2007.
4.  Proposals were received on December 17, 2007 from two firms. The two
    firms were:
    - Camp Dresser and McKee, Inc.
    - R. D. Zande & Associates, Inc.
5.  The evaluation and final ranking of the firms were based upon the criteria
    specified in the RFP.
6.  On January 16, 2008, the Evaluation Committee reported its ranking to the
    Director.  Both firms were notified in writing of the final selection by the
    Director.
7.  Subsequent discussions and negotiations with the selected firm have
    resulted in further refinement of the scope of the work and results in this
    ordinance.  The name and address of the selected firm is Camp, Dresser
    and McKee, Inc., 8800 Lyra Drive, Columbus, Ohio 43240.

D.      Emergency Designation:  Emergency designation is not requested.
 
 
2.      FISCAL IMPACT:
 
This ordinance authorizes the transfer of funds from within the Sanitary Sewer Revenue Bonds Fund for the purpose of providing the necessary funding required for this expenditure. There will also be an amendment to the 2007 Capital Improvements Budget to provide sufficient budget authority.  This legislation will authorize the expenditure of $2,162,196.00 within the Sanitary Sewer Revenue Bonds Fund.

WHEREAS, the procurement was conducted in accordance with the Request For Proposals (RFP) process set forth in Section 329.14, Columbus City Codes, 1959: two proposals were received and the Division's Evaluation Committee selected Camp, Dresser, and McKee, Inc. from among the two firms; and
 
WHEREAS, it is necessary to authorize the transfer funds within the Sanitary Sewer Revenue Bonds Fund to provide sufficient funding for the aforementioned project expenditure; and
 
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and
 
WHEREAS, it is necessary for the City Council to authorize the expenditure of funds from the Sanitary Sewer Revenue Bonds Fund; and
 
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to enter into an agreement for professional engineering services with Camp, Dresser, and McKee, Inc. in connection with the Wastewater Treatment Facilities Instrumentation and Control (I&C) System Upgrade, Facilities Integration and Support Services project, pursuant to the successful completion of this vital wastewater treatment plant infrastructure, at the earliest practicable date; Now, Therefore,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.   That the Director of Public Utilities be, and hereby is, authorized to enter into an agreement for professional engineering services with Camp, Dresser, and McKee, Inc., 8800 Lyra Drive, Columbus, Ohio  43240, in connection with the Wastewater Treatment Facilities Instrumentation and Control (I&C) System Upgrade, Facilities Integration and Support Services project, in accordance with the terms and conditions as shown in the agreement on file in the office of the Division of Sewerage and Drainage.
 
Section 2.  That the City Auditor is hereby authorized to transfer $2,162,196.00  within the Sanitary Sewer Revenue Bonds Fund, Fund 665; Object Level Three 6678; Division of Sewerage and Drainage; Div. 60-05:

Section 3.  That the 2007 Capital Improvements Budget Ordinance No.0733-2007 is hereby amended as follows, to provide sufficient budget authority for the award of the agreement stated herein:

Section 4.  That for the purpose of paying the cost of the professional engineering services contract, the expenditure of $2,162,196.00, or as much thereof as may be needed, is hereby authorized from the Sanitary Sewer Revenue Bonds Fund, Fund No. 665 | Division 60-05 | Project No. 650348.2 | OCA Code 665348 | Object Level Three 6678.
      
Section 5.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 8.  That said firm shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
 
Section 9.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
