Rezoning Application Z08-070
 
APPLICANT:  Craig Frazier; c/o Robert W. Johnson, Architect; 5120 Nike Drive, Suite B; Hilliard, Ohio 43026.
 
PROPOSED USE:  Limited industrial and commercial development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (4-0) on February 12, 2009.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The site is developed with three office-warehouse buildings in the L-M-2, Limited Manufacturing District.  The requested L-M, Limited Manufacturing District will allow limited commercial uses along with industrial development.   The L-M text contains use restrictions, setback commitments, landscaping and sidewalk provisions.  The site is located in the planning area of the West Columbus Interim Development Plan (1991), which recommends industrial uses for this location.  Staff has determined that the proposed commercial uses are consistent and compatible with the industrial development pattern of the area.

WHEREAS, application #Z08-070 is on file with the Building Services Division of the Department of Development requesting rezoning of 4.02± acres from L-M-2, Limited Manufacturing District, to L-M, Limited Manufacturing District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested L-M, Limited Manufacturing District will allow limited commercial development that is consistent and compatible with the land use recommendations of the West Columbus Interim Development Plan (1991) and the surrounding industrial development pattern of the area, now, therefore:    
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
5040-5120 NIKE DRIVE (43026), being 4.02± acres located at the northwest corner Nike Drive and Atlas Street, and being more particularly described as follows:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, being 4.022 acres all out of that Lot 8 as same is designated and delineated upon the recorded plat of "WALCUTT INDUSTRIAL PARK" of record in Plat Book 45, Page 40, (all references in this description are to the records in the Recorder's Office, Franklin County, Ohio) and being more particularly described as follows:
 
Beginning, for reference, at a P.K. nail found at the centerline intersection of Nike Drive (80' wide right-of-way) and Atlas Street (80.00' wide right-of-way) as shown on said Plat Book 45, Page 40;
 
Thence North 08° 14' 20" West 316.00 feet, along the centerline of said Atlas Street, to a point;
 
Thence South 81° 45' 40" West 40.00 feet to a Mag nail set on the westerly right-of-way line of Atlas Street, THE TRUE POINT OF BEGINNING;
 
Thence the following three (3) courses being along right-of-way lines of Atlas Street and Nike Drive and being along lines of said Lot 8:
 
1)  South 08° 14' 20" East 226.00 feet, to an iron pin set at a point of curvature;
2)  Thence southwesterly along the arc of a curve to the right, having a radius of 50.00 feet, a central angle of 90° 00' 00", the arc length of 78.54 feet, the chord bearing South 36° 45' 40" West 70.71 feet, to a 3/4" hollow iron pin found at the point of tangency;
3)  Thence South 81° 45' 40" West 586.46 feet to an iron pin set at the southeasterly corner of Lot 6 of said plat, the southwest corner of Lot 8;
 
Thence North 08° 20' 02" West 276.00 feet, along the common line between said Lots 6 and 8, to an iron pin set;
 
Thence North 81° 45' 40" East 636.91 feet, crossing said Lot 8 with a new division line, to the True Point of Beginning, containing 4.022 acres of land, more or less, subject to any easements, restrictions or right-of-ways of previous record.
 
NOTE:  Bearings are used for the determination of angles only.  For the purpose of this description, a bearing of South 81° 45' 40" West was used on the northerly right-of-way line of Nike Drive at Lot 8, as shown on Plat Book 45, Page 40.  The iron pins set are 5/8" rebars, 30" long with yellow plastic caps stamped "SITE ENG INC."
 
The above description was prepared from an actual field survey of the premises during December, 2005 by Site Engineering, Inc.

1.     INTRODUCTION:  The subject site (4.021 acres) sits on the northwest corner of the intersection of Nike Drive and Atlas Street.  The site is currently zoned L-M-2.  The applicant proposes to rezone to L-M, Limited Manufacturing District to allow limited commercial development.
 
 
2.      PERMITTED USES:  The following uses shall be permitted.
       All uses listed in Section 3353.03 (C-2); the following commercial uses: appliance maintenance and repair; camera, photo finishing and photographic supplies stores; computer and software stores; hardware stores; pet day care, grooming , pets and supplies (with outside runs or boarding); automobile driving training facility; building material and supplies dealers; dance or gymnastic studios; floor covering stores; linen and uniform supply; reupholster and furniture repair; carpet and upholstery cleaning services; exterminating and pest control services; veterinarians; and all uses listed in Section 3363.02 through 3363.08.
 
3.      DEVELOPMENT STANDARDS:  Except as specified herein, the applicable development standards shall be as specified in Chapter 3363 M-Manufacturing district.
 
a.     Density, height, lot and/or set back commitments:
1.      Building height shall be restricted to 35 feet.
2.      Building lines:  Building setback shall be 50' from r/w line on Nike Drive and Atlas Street.
3.      Parking setback:  parking set back shall be 30' from r/w line on Nike Drive and Atlas Street.
 
b.     Buffering, landscaping, open space and/or screening commitments:
1.      Landscaping shall be per 3342.11
2.      One evergreen shall be provided in the parking setback for every 40 lineal feet of frontage.  The minimum size at installation shall be five feet in height.
3.      All trees and landscaping shall be well maintained.  Weather permitting, dead items shall be replaced within six months.
 
c.     Miscellaneous commitments:
1.      Sidewalks shall be provided by the applicant along street frontages within one year of the effective date of this rezoning.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
