Council Variance Application: CV26-030

 

APPLICANT:  Custom Home Building Consultants; c/o Gary Dunn; 3060 Abbey Knoll Drive; Lewis Center, OH 43035.

 

PROPOSED USE:  Mixed-use development.

 

NORTH CENTRAL AREA COMMISSION RECOMMENDATION:  Approval.

 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The applicant has received a recommendation of approval from Staff and the Development Commission for a concurrent rezoning (Ordinance #1612-2026; Z25-070) to the L-M-2, Limited Manufacturing District for limited less-objectionable manufacturing and office uses. The requested Council variance will allow the residential component of a proposed mixed-use building which consists of three dwelling units, and includes reduced development standards for required parking, loading space size, parking and building setbacks, and landscaped area. A Council variance is required because the L-M-2 district does not allow residential uses. The proposed mixed-use development also includes limited less-objectionable manufacturing and office uses. The request is consistent with the Columbus Growth Strategy’s “Mixed-Use 2” land use recommendation, and provides additional housing options for the neighborhood.

To grant a Variance from the provisions of Sections 3367.01, M-2 manufacturing district; 3312.49(C), Required parking; 3312.51, Loading space; and 3367.15(a)(c)(d), M-2 manufacturing district special provisions, of the Columbus City Codes; for the property located at 2006 E. 5TH AVE. (43119), to allow three dwelling units within a proposed mixed-use building with reduced development standards in the L-M-2, Limited Manufacturing District (Council Variance #CV26-030).

 

Body

 

WHEREAS, by application #CV26-030, the owner of the property 2006 E. 5TH AVE. (43119), requests a Council variance to allow three dwelling units within a proposed mixed-use building with reduced development standards in the L-M-2, Limited Manufacturing District; and

 

WHEREAS, Section 3367.01, M-2 manufacturing district, does not allow residential uses, while the applicant proposes three dwelling units within a proposed mixed-use building in the L-M-2, Limited Manufacturing district; and

 

WHEREAS, Section 3312.49(C), Required parking, requires one space per 450 square feet for general office; one space per business plus one space per 1,000 square feet of warehousing for the first 20,000 square feet; and two spaces per dwelling unit for a total of 20 required parking spaces, while the applicant proposes to provide a total of 12 spaces; and

 

WHEREAS, Section 3312.51, Loading space, requires loading spaces to have minimum dimensions of not less than 12 feet in width and 50 feet in length, exclusive of any driveway, aisle, or other circulation area, while the applicant proposes to reduce the length of provided loading spaces to 20 feet and allow loading spaces to occupy the same area as the proposed circulation area, as shown on the submitted site plan; and

 

WHEREAS, Section 3367.15(a)(c)(d), M-2 Manufacturing district special provisions, requires that any building or structure of any type shall be located not less than 50 feet from the street line, with the portion of the lot or parcel abutting the street line being landscaped to a depth of 50 feet, and that no portion of the required 50-foot buffer shall be used for either off-street parking or loading spaces, while the applicant proposes a reduced building setback and landscaped depth of 6.5 feet along E. 5th Avenue and 15 feet along Brentnell Avenue, and to allow parking, loading facilities, and maneuvering within the 50 foot buffer area along Brentnell Avenue; and

 

WHEREAS, the North Central Area Commission recommends approval of said zoning change;

 

WHEREAS, City Departments recommend approval because the request will allow development that is consistent with the Columbus Growth Strategy’s land use recommendation at this location, and provides additional housing options for the neighborhood; and

 

WHEREAS, this ordinance requires separate submission for all applicable permits and a Certificate of Zoning Clearance for the proposed development; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 2006 E. 5TH AVE. (43119), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance is hereby granted from the provisions of Sections 3367.01, M-2 manufacturing district; 3312.49(C), Required parking; 3312.51, Loading space; and 3367.15(a)(c)(d), M-2 manufacturing district special provisions, of the Columbus City Codes; for the property located at 2006 E. 5TH AVE. (43119), to allow three dwelling units within a mixed-use building in the L-M-2, Limited Manufacturing District; with a parking space reduction from 20 required to 12 provided spaces; reduced length of loading spaces from 50 feet to 20 feet and to allow loading spaces to occupy the same area as the circulation area; reduced building setback and landscaped depth from 50 feet to 6.5 feet along E. 5th Avenue and 15 feet along Brentnell Avenue; and to allow parking, loading facilities, and maneuvering within the required 50 foot buffer area along Brentnell Avenue with a parking and loading setback of 15 feet; said property being more particularly described as follows:

 

2006 E. 5TH AVE. (43119), being 0.44± acres located at the northwest corner of E. 5th Avenue and Brentnell Avenue, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin and City of Columbus:

 

Being Lots Numbered Ninety-Eight (98), Ninety-Nine (99), One Hundred (100), One Hundred One (101) and One Hundred Two (102) of H. H. Parson’s Addition, as the same are numbered and delineated upon the recorded plat thereof, of record in Plat Book 7 Page 238, Recorder’s Office, Franklin County, Ohio.

 

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a mixed-use building containing three dwelling units, or those uses allowed in the L-M-2, Limited Manufacturing District as specified by Ordinance #1612-2026 (Z25-070).

 

SECTION 3. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Zoning Clearance for the proposed development.

 

SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
