Explanation

 

BACKGROUND:

This legislation authorizes the Director of the Department of Technology and the Director of the Department of Public Utilities to renew an annual agreement (Service Contract # L693) with PerkinElmer Health Sciences, Inc. formerly known as PerkinElmer, dba PerkinElmer Life & Analytical Sciences, for maintenance and support on the Laboratory Information Management System (LIMS).  The twelve month coverage period for the maintenance and support contract is June 1, 2010 through May 31, 2011.  This agreement provides computer programming software maintenance on the LIMS system and obligates PerkinElmer Health Sciences, Inc. to provide upgrades, new releases, and technical support for the software licenses to the Department of Public Utilities.  The amount of funds needed for the renewal of this annual maintenance and support agreement is $52,782.00.

 

This ordinance will authorize the assignment of all past, present and future business done by the City of Columbus with PerkinElmer, dba PerkinElmer Life & Analytical Sciences, FID 04 3361624; to PerkinElmer Health Sciences, Inc. same FID, with the contract compliance expiring 03/02/2012.

 

This ordinance also requests approval to continue services provided by PerkinElmer Health Sciences, Inc. in accordance with sole source procurement provisions of Section 329 of the Columbus City Code; as it has been determined PerkinElmer Health Sciences, Inc. is the sole distributor of LIMS, and does not utilize distributors or re-sellers due to the complex nature of its product. 

 

On November 24, 2008 Council approved and passed ordinance #1738-2008 that authorized the Director of the Department of Public Utilities to enter into an agreement with PerkinElmer in the amount of $519,852.00 for the design, purchase and implementation of a new Laboratory Information Management System with accompanying Operations Data System.  The selection of PerkinElmer Health Sciences, Inc. was performed in accordance with the procedures set forth in Columbus City Code, Section 329.14, "Awarding professional service contracts through requests for proposals."  LIMS enables the Division of Sewer and Drainage (DOSD) and the Division of Power and Water (DOPW) to manage water quality sample information, incorporate input from plant operations data sources, track 79,000 tests on 16,000 different samples annually, and transfer approved results to end users automatically.  The LIMS system has replaced older information systems, allowing DOSD and DOPW to satisfy their regulatory reporting requirements more efficiently.

 

EMERGENCY: Emergency designation is requested to immediately facilitate prompt payment and to avoid interruption in the performance of services in the usual daily operation.

  

FISCAL IMPACT:  In 2008, $519,852.00 was established on a contract via ordinance #1738-2008/Purchase Order EL008929 with PerkinElmer for software and related services to support the LIMS project by the Department of Public Utilities.  Of this total contract amount $416,791.70 was used to purchase LIMS software, including the first year of maintenance and support.  Passage of this ordinance will authorize the expenditure of $52,782.00 from the Department of Technology Internal Service Fund. With this renewal, the aggregate contract cost for maintenance and support will total $93,038.00.

Body

 

WHEREAS, the Director of the Department of Technology and the Director of the Department of Public Utilities has a need to renew an annual agreement to provide maintenance and support with PerkinElmer Health Sciences, Inc. for a twelve month period from June 1, 2010 through May 31, 2011; and

 

WHEREAS, this agreement provides computer programming software maintenance on the Laboratory Information Management System (LIMS) and obligates the vendor to provide upgrades, new releases and technical support for the software licenses to the Department of Public Utilities; and

 

WHEREAS, this ordinance will authorize the assignment of all past, present and future business done by the City of Columbus with PerkinElmer, dba PerkinElmer Life & Analytical Sciences, FID 04 3361624 to PerkinElmer Health Sciences, Inc. with the same FID, with contract compliance expiring on 03/02/2012.

 

WHEREAS, it is best to continue with these services in order to provide continuous support to the Department of Public Utilities to insure the required management of water quality information and reporting; and

 

WHEREAS, this agreement is being established in accordance with the sole source provisions of the Columbus City Code, Section 329.07; and

 

WHEREAS, an emergency exist in the usual daily operation of the Department of Technology and the Department of Public Utilities, in that it is immediately necessary to renew an annual agreement with PerkinElmer Health Sciences, Inc. to provide computer programming software maintenance and support on the LIMS system so as to not negatively impact the operation of the services provided by the Department of Public Utilities thereby preserving the public health, peace, property, safety and welfare; now therefore

 

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1:  That the Director of the Department of Technology and the Director of the Department of Public Utilities are hereby authorized to renew an annual agreement (PerkinElmer Service Contract # L693) with PerkinElmer Health Sciences, Inc. to provide computer programming software maintenance and support on the LIMS system, and of which the agreement also obligates PerkinElmer Health Sciences, Inc. to provide upgrades, new releases and technical support on the software licensed to the Department of Public Utilities, in the amount of $52,782.00 for a twelve month period from June 1, 2010 through May 31, 2011. Also, this ordinance provides for the authorization to modify the assignments of all past, present and future contracts and purchase orders pursuant to those contracts to reflect the change of the company name from PerkinElmer, dba PerkinElmer Life & Analytical Sciences, FID 04 3361624 to PerkinElmer Health Sciences, Inc., same FID, with the contract compliance expiring on 03/02/2012.

 

SECTION 2:  That the expenditure of $52,782.00 or so much thereof as may be necessary is hereby authorized to be expended from:

SECTION 5: That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
