Explanation
 
The purpose of this legislation is to authorize the Director of Public Utilities to enter into a service agreement with Cues Incorporated for Telemonitoring Equipment Parts and Repair Services. The agreement for this service will be established in accordance with Section 329.07 of the Columbus City Code.  Cues Incorporated is the manufacturer of the equipment and is the sole provider of parts, software support and repairs.
 
The Sewer Maintenance Operations Center utilizes telemonitoring trucks in the SLIRP (Sewer Line Inspection and Rehabilitation Program) section. The equipment is used to show video of the various sanitary and stormwater lines to determine maintenance and repair needs and to inspect the lines. The TV trucks are manufactured by Cues Incorporated and the parts and service can only be provided by the company. An informal quote was received from Cues Incorporated detailing per hour rates for labor for repairs of $95.00 per hour, $95.00 per hour for alignment and $110.00 per hour for one-day turnaround service. See attached letter. The service will be in effect for one (1) year to and including May 31, 2011.
 
It is requested that this ordinance be handled in an emergency manner in order to expedite the completion of the new agreement, prior to the expiration of the current agreement so as not to have a lapse in coverage.

Body
 
WHEREAS, Cues Incorporated is the manufacturer and sole provider of parts and service for the telemonitoring trucks utilized by the Division of Sewerage and Drainage, and,
 
WHEREAS, a per hour service rate of $95.00 per hour, per hour rate of $95.00 for alignment, $110.00 per hour rate for one-day turnaround has been submitted by the company, and,
 
WHEREAS, the contract will be in effect for one (1) year to and including May 31, 2011, and
 
WHEREAS, it is necessary to enter into an agreement for Telemonitoring Equipment Parts and Repair Services in accordance with the Sole Source Provisions of Columbus City Code, Section 329.07, and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the Public Utilities Director to enter into an agreement for Telemonitoring Equipment Parts and Repair Services prior to the expiration of the current agreement so as not to have a lapse in coverage; for the immediate preservation of the public health, peace, property and safety; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. This Council finds it in the best interest of the City of Columbus to authorize the Director of Public Utilities to enter into a service agreement for Telemonitoring Equipment Parts and Repair Services for the Sewer Maintenance Operations Center for a period of one (1) year in accordance with the provisions of Columbus City Code, Section 329.07. Expiration of the contract will be May 31, 2011.
 
Section 2. That for the purpose stated in Section 1 hereof, the expenditure of $60,000.00, or so much thereof as may be necessary, be and is hereby authorized from the Sewerage System Operating Fund, 650 as follows, to pay the cost thereof.

Section 3. That for the reasons stated in the preamble hereto, where is hereby made a part hereof, this ordinance, is hereby declared to be an emergency measure, which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
