Explanation
BACKGROUND: To change the company name and Federal Identification number for the contract, related purchase orders and bid award established with ITT Flygt Corporation to ITT Water & Wastewater U.S.A. The UTC contract for Flygt Pump Parts and Service (SA002382) and related purchase orders were previously established with ITT Flygt Corporation. In addition, Ordinance 0536-2009 passed 4/13/09 authorized award of SA003204, the new UTC contract for Flygt Pump Parts and Services, with ITT Flygt Corporation. The vendor has changed their name and federal tax id #. This ordinance authorizes the assignment of all past, present and future business done by the City of Columbus under authority of SA002382, FL003592 and under authority of SA003204 from ITT Flygt Corporation FID22-2334939 to ITT Water & Wastewater U.S.A. FID 23-2914590 (contract compliance valid thru 04/29/2011).
1. Amount of additional funds: No additional funds are necessary to modify the option contract.
2. Reason additional needs were not foreseen: Needs have not changed, this is a reassignment only.
3. Reason other procurement processes not used: The same exact product is required as originally bid. No lower pricing/more attractive terms and conditions are anticipated through rebidding at this time.
4. How cost was determined: Terms and conditions are in accordance with the original agreements.
FISCAL IMPACT: No additional monies are required to modify the option contracts. Each agency must set aside their own funding for their estimated expenditures.
In order to maintain an uninterrupted supply of Flygt Pump Part and Services to City agencies using Universal Term Contract SA002382, FL003592 and SA003204 and open Purchase Orders, this ordinance is being submitted as an emergency.
Title
To authorize and direct the Finance and Management Director to modify an existing option contract, a pending contract, as well as all past, present and future purchase orders for Flygt Pump Parts and Service with ITT Flygt Corporation, to reassign all rights and responsibilities to ITT Water & Wastewater U.S.A.; and to declare an emergency.
Body
WHEREAS, the Finance and Management/Purchasing Office established an option contract, FL003592, and there are in existence purchase orders with ITT Flygt Corporation for the option to purchase Flygt Pump Parts and Service for use primarily by the Division of Sewerage and Drainage; and
WHEREAS, the Finance and Management/Purchasing Office received bids for Flygt Pump Parts and Services (SA003204) and awarded, under authority of Ordinance 0536-2009 passed April 13, 2009, to ITT Flygt Corporation; and
WHEREAS, ITT Flygt Corporation has changed its name and federal tax identification and it is now necessary modify the existing contract, purchase order and bid documents to have all rights assigned to ITT Water & Wastewater U.S.A.; and
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management/Purchasing Office in that it is immediately necessary to modify FL003592 and purchase orders established for Flygt Pump Parts and Service and modify award authorized by Ordinance 0536-2009 in response to SA003204, thereby preserving the public health, peace, property, safety, and welfare, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director be and is hereby authorized and directed to modify FL003592 and all past, present and future contracts and purchase orders pursuant to FL003592 and to modify the award authorized by Ordinance 0536-2009 in response to SA003204 to reflect the change of the company name and FID number from ITT Flygt Company, 22-2334939 to ITT Waste & Wastewater, 23-2914590.
SECTION 2. That this modification is in accordance with Section 329.16 of the Columbus City Codes.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
