Explanation
Broughton Avenue intersects with Outerbelt Street that is located off East Broad Street just east of the Lucent site.  The developed section of this site houses industrial businesses.  The undeveloped section, over 30 acres, is located to the north.  Due to its industrial nature, a significant amount of traffic to and from this site is truck traffic.  Traffic on East Broad Street has increased each year making it progressively more difficult for trucks to turn left onto Broad Street.  Tenants have left and new tenants are difficult to attract due to the access problem.  Five years ago the vacancy rate among 20 office and office/warehouse buildings consisting of 468,000 square feet was zero percent ; currently the vacancy rate is 32 percent.  The 30-acre site can accommodate up to 400,000 additional square feet.  Translating square footage to employees, more than 1,030 employees could be accommodated at this site.
 
The owners of the buildings along Outerbelt Street financed an independent traffic study that concluded that a traffic signal at Outerbelt Street and East Broad Street was warranted.  Because of the close proximity of traffic signals at the Lucent site and Brice Road, the Transportation Division proposed that Broughton Street be extended to McCormick Boulevard so the existing traffic signal at Brice Road and East Broad Street can be utilized.  The Economic Development Division has determined that the cost of extending Broughton Avenue is warranted.
 
This legislation authorizes the City to enter into a contract in an amount up to $607,616.09 for the Broughton Avenue Extension project, to pay construction inspection costs up to $90,772.86 and to pay American Electric Power Company $1,611.05 for the facilities to provide power for the street lights.  This improvement details the extension of Broughton Avenue from its east terminus to McCormick Boulevard by adding a bridge, pavement, sidewalks, street lighting and storm sewers.  The estimated Notice to Proceed date is April 24, 2006.  The contractor has been given ninety days to complete construction.  The project was let by the Transportation Division and was advertised in the City Bulletin and Dodge Reports and by the Builders Exchange.  Seventeen bidders/suppliers were solicited (15 majority, 2 minority) and 10 bids were received (9 majority, 1 minority) and tabulated on January 13, 2006 as follows:

Award of the contract is recommended to Complete General Construction Company, contract compliance #31-4366382 (expires March 1, 2008) as the lowest, best, most responsive and most responsible bidder.
 
Fiscal Impact:  Funding for this project is available within the Transportation Division's 2005 Capital Improvement Budget in the 1995, 1999, 2004 Voted Streets and Highways Fund in the Miscellaneous Development project.  This project will use the $500,000.00 originally allocated to the Roberts Road/Wilson Road intersection improvement and $200,000.00 originally allocated to the Northland Mall project within the Northland and Other Acquisitions Fund.  The schedules for these two projects have changed.  The Roberts/Wilson intersection improvement project needs design revisions and it will not be ready to be bid until fall.  The Northland Phase 2 project will not be constructed until after the Tamerack extension is completed (construction is scheduled to commence this summer); therefore Phase 2 funds will not be needed until spring 2007.  Funds for these delayed projects will be requested for a future bond sale.
 
Emergency action is requested to provide for immediate contract execution to allow the contractor to mobilize so that construction can commence in April to allow the contractor the advantages of the full construction season.

Body
WHEREAS, bids were received on January 12, 2006 and tabulated on January 13, 2006 for the Broughton Avenue Extension project and a satisfactory bid has been received; and
 
WHEREAS, it is necessary to provide for construction inspection costs and services provided by American Electric Power Corporation;  now, therefore and
 
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division in that the contract should be awarded immediately so that the work may commence in April to allow the contractor the advantages of the full construction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Public Service Director be and hereby is authorized to enter into a contract with Complete General Construction Company, 1221 East Fifth Avenue, Columbus, Ohio 43219, for the construction of the Broughton Avenue Extension project in the amount of $607,616.09 for the Transportation Division in accordance with the specifications and plans on file in the office of the Public Service Director, which are hereby approved; to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $90,772.86, to obtain and pay for the necessary installation costs to American Electric Power Corporation (AEP) associated with the project up to a maximum of $1,611.05.
 
SECTION 2.  That for the purpose of paying the cost of the contract, inspection and AEP service provision, the sum of $700,000.00 or so much thereof as may be needed be and hereby is authorized to be expended from Fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 644385, and project 590131 ($500,000.00) and from Fund 735, the Northland and Other Acquisitions Fund, Department No. 44-01, Development Department, Object One Code 06, Object Level Three Code 6631, OCA Code 441735, and project 441735 ($200,000.00).
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
