Counsel for Appellee

Columbus City Code 3359.05(E) states “Upon the request of any person directly affected by a commission decision of a certificate of appropriateness, will be forwarded to city council for reconsideration by the filing of a notice of appeal with the city clerk within 30 days after the date of the commission's decision.”

The Appellant has filed a notice of appeal and is requesting reconsideration of the Downtown Commission decision by City Council. The record has been filed with the City Clerk. The Council will reconsider the decision of the Downtown Commission by conducting a de novo review of the evidence submitted to the Commission (no additional evidence is to be submitted, the parties are confined to the record made before the Commission).

Oral arguments shall be held during the Zoning Committee meeting on October 5, 2026. Each side will be allotted 15 minutes; the Appellant may reserve time for rebuttal.

The hearing will be broadcast live on CTV, YouTube, and Facebook.

The Council will issue a written decision within a reasonable period of time, following oral argument. The Council’s decision will be a final, appealable order.
