Explanation
The Public Service Department, Transportation Division, recently received a request asking that the City release the five foot wide platted easement located along the easterly line of Lot 16 of the Town Square Villages at Preserve Crossing as shown on the plat of record in Plat Book 106, Pages 59 and 60, of the Franklin County, Ohio Recorder's Office. The building foundation on Lot 16 has been constructed 4.1 feet from the easterly lot line and encroaches into this platted easement. After receipt of this request the Transportation Division verified with all the public and private utility companies that there are no utilities located within this five-foot wide platted easement and that they have no objections to the release of this platted easement. A value of $500.00 was established for the release of this platted easement. The following legislation authorizes the Director of the Public Service Department to execute those documents necessary to release the five-foot wide platted easement located along the easterly line of Lot 16 of the Town Square Villages at Preserve Crossing
The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the release of the platted easement along the easterly line of Lot 16 of the Town Square Villages at Preserve Crossing.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request asking that the City release the platted easement located along the easterly line of Lot 16 of the Town Square Villages at Preserve Crossing, of record in Plat Book 106, Pages 59 and 60, of the Franklin County, Ohio Recorder's Office; and
WHEREAS, the building foundation on Lot 16 has been constructed 4.1 feet from the easterly lot line and encroaches into this platted easement; and
WHEREAS, after receipt of this request the Transportation Division verified with all the public and private utility companies that there are no utilities located within this five foot wide platted easement and that they have no objections to the release of this platted easement; and
WHEREAS, a value of $500.00 has been established for the release of this platted easement; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Public Service Department be and is hereby authorized to execute those documents necessary to release the five foot wide platted easement along the easterly line of Lot 16 of the Town Square Villages at Preserve Crossing, of record in Plat Book 106, Pages 59 and 60 of the Franklin County, Ohio, Recorder's Office.
Section 2. That the $500.00 to be received by the City as consideration for the above referenced release shall be deposited in Fund 748, Project 537650.
Section 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
