Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to execute a planned contract modification with M-E Companies, Inc. to the Division of Sewerage and Drainage's General Engineering Services Contract. This modification will increase the funding for the contract services by an additional $145,000.00. These services will provide engineering design services associated with the Scioto River West Floodwall Project, and to address some localized stormwater drainage problems on the west side of the City of Columbus. The subsequent construction phase will be procured using the competitive bidding provisions of the Columbus City Codes.
2. CONTRACT MODIFICATION INFORMATION:
This contract was originally procured for purposes of providing "blanket" type of service contracts to augment engineering personnel within the Sewer System Engineering Section (SSES) of the Division of Sewerage and Drainage on an as-authorized, as needed basis. The contract was established with fixed direct labor, overhead and fixed fee rates for the period of 2006 through 2009. This ordinance will authorize the establishment of $145,000.00 in additional funding for the aforementioned services. Under the terms of this contract, the City has the right to contract for addtional services to fulfill emergency capital improvements or smaller scoped projects, subject to the approval of a contract modification by City Council to provide general engineering services for the Division of Sewerage and Drainage. The rates established within this contract will remain in force throughout the life of the contract.

4. FISCAL IMPACT:
The legislation includes a transfer of funds within the Storm Sewer Bond Fund and an amendment to the 2007 Capital Improvements Budget to allow sufficient cash and authority in the proper account for this project.

WHEREAS, Ordinance No. 1568-2006, as passed October 16, 2006, authorized the Director of Public Utilities to enter into a professional engineering services contract with M-E Companies, Inc., for General Engineering Services; and
WHEREAS, the Division of Sewerage and Drainage Engineering personnel have determined that there are stormwater projects that are in need of these engineering services; and
WHEREAS, the Division of Sewerage and Drainage engineering personnel have determined it to be in the best interest of the City of Columbus to increase the contract amount to incorporate stormwater projects to obtain services with M-E Companies, Inc. through the existing contract; and
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Storm Sewer Bond Fund; and
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient budget authority for the project expenditure; and
WHEREAS, it is necessary for the City Council to authorize the expenditure of funds from the Storm Sewer Bond Fund; and
WHEREAS, it is therefore necessary for the Division of Sewerage and Drainage, Department of Public Utilities, to request this City Council to authorize the Director of Public Utilities to modify the subject contract for purposes of including stormwater projects in existing scope of services and to allow for the increased cost of said services, at the earliest practicable date, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor be and hereby is authorized and directed to transfer a total of $145,000.00 from within the Storm Sewer Bond Fund No. 685| Division 60-15| Object Level Three No. 6682:

Section 2. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 3. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
Section 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
Section 5. That the Director of Public Utilities be, and hereby is, authorized to execute an agreement with M-E Companies, Inc., 635 Brooksedge Blvd., Westerville, Ohio 43081 for the Division of Sewerage and Drainage, for professional engineering services modification in accordance with the terms and conditions on file in the office of the Division of Sewerage and Drainage.
Section 6. That the said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
Section 7. That the 2007 Capital Improvements Budget Ordinance No. 0733-2007 is hereby amended as follows, to provide sufficient budget authority for the execution of the engineering services stated in the ordinance herein.

Section 8.
