Explanation
Background:
This ordinance will authorize the Director of Recreation and Parks to enter into a contract with Miles McClellan Construction Co. for professional services in conjunction with The North Bank Park Project in the amount of $703,074.00.
Proposals were received on April 18, 2003, from six firms and three firms were interviewed. Firms interviewed included Ruscilli Construction (Majority), H. R. Gray Associates (Majority), and Miles McClellan Construction Co. (MBE). Miles McClellan Construction Co., 2100 Builders Place, Columbus, Ohio, 43204, was selected for this project for various reasons including experience, location, availability, and familiarity and expertise with Downtown Riverfront development. The contract will be awarded to Miles McClellan Construction Co. in accordance with the provisions of Section 329.12 of the Columbus City Codes.

The approximate cost of Recreation and Parks staff time on this project is $20,000.00 (02-011).
Emergency action is necessary to allow Miles McClellan to begin work as plans for the park are moving forward and it will be beneficial to have them working as soon as possible.
Fiscal Impact:
$723,074.00 is required and budgeted in the Recreation and Parks Grant Fund to meet the financial obligation of this professional services contract.

WHEREAS, proposals for professional services were received and evaluated by the Recreation and Parks Department for The North Bank Park Project Project; and
WHEREAS, in accordance with the provisions of Section 329.12 of the Columbus City Codes, the contract will be awarded to Miles McClellan Construction Co., in the amount of $703,074.00; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into said contract for the preservation of public health, peace, property and safety; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with Miles McClellan Construction Co., for professional services in conjunction with The North Bank Park Project.
SECTION 2. That the expenditure of $723,074.00, or so much thereof as may be necessary, be and is hereby authorized from the Recreation and Parks Grant Fund, as follows, to pay the cost thereof.

SECTION 3. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
