Title: To authorize the appropriation of $120,000 from the indigent drivers alcohol treatment fund to the Franklin County Municipal Court Judges, pursuant to the requirements of O.R.C. 4511.191; and to declare an emergency. ($120,000.00)
Explanation
 
This ordinance appropriates $120,000 in 2005, to the Franklin County Municipal Court Judges from the indigent drivers alcohol treatment fund.  The Municipal Court Judges in consultation with the Alcohol, Drug Addiction, and Mental Health Services  (ADAMH) Board and in accordance with O.R.C. 4511.191 and House Bill 66 (H3)(H4), have declared a surplus in the fund.  Appropriations will be used to provide for the purchase of electronic continuous alcohol monitoring devices and chemical dependency treatment for indigent offenders.  The ADAMH Board administers the indigent drivers alcohol treatment program of the Court, pursuant to O.R.C. 4511.191 (H)(4)(a).  This legislation is considered an emergency measure to ensure the continuation of uninterrupted payments to the referred treatment centers and acquisition of the alcohol monitoring devices.

Whereas, ordinance number 2070-90 passed by Columbus City Council on July 23, 1990 established the indigent drivers alcohol treatment fund as a special revenue fund; and
 
Whereas, the Alcohol, Drug Addiction, and Mental Health Services (ADAMH) Board administers the indigent drivers alcohol treatment program of the Court, pursuant to O.R.C. 4511.91 (N); and
 
Whereas, surplus funds have been declared by the Municipal Court Judges in consultation with the ADAMH Board that will be used to provide funding for electronic monitoring and chemical dependency treatment for indigent offenders; and
 
Whereas, an emergency exists in the ususal daily operation of the Franklin County Municipal Court Judges such that it is immediately necessary to appropriate the aforementioned funds in order to provide continued funding to acquire electronic monitoring devices and chemical dependency treatment, thereby preserving the public health, peace, property, safety and welfare; Now, Therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1.  That from the unappropriated monies in the special revenue fund known as the indigent drivers alcohol treatment fund, fund number 225, subfund 001, and from any and all monies estimated to come into said fund, from any and all sources and appropriated for any other purpose during the fiscal year ending December 31, 2005, the sum of $120,000 is appropriated to the Franklin County Municipal Court Judges, department number 25, as follows: $58,000 to oca number 250266, object level 1 -- 02, object level 3 -- 2290; $62,000 to oca number 250213, object level 1 -- 03, object level 3 -- 3336.
 
Section 2.  That the monies appropriated in the foregoing Section 1 shall be paid upon order of the Franklin County Municipal Court Judges; and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
 
Section 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
