PROPOSED USE:  Parking lot development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on July 10, 2003.
 
CLINTONVILLE AREA COMMISSION RECOMMENDATION:  Approval.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  This application has been scaled back from the original request and preserves viable housing west of the alley.  The proposal to rezone the existing parking lot for seven parking spaces for the redevelopment to the north is consistent with the zoning and development patterns of the area.

WHEREAS, application #Z03-028 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.12± acres from C-4, Commercial District to CPD, Commercial Planned Development District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the Clintonville Area Commission recommends approval; and
 
WHEREAS, the City Departments recommend approval of said zoning change because this application has been scaled back from the original request and preserves viable housing west of the alley.  The proposal to rezone the existing parking lot for seven parking spaces for the redevelopment to the north is consistent with the zoning and development patterns of the area, now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
24 BRIGHTON ROAD (43202), being 0.12± acres located on the north side of West Brighton Road,  west side of High Street, and being more particularly described as follows:
 
Being situated in the County of Franklin, State of Ohio and in the City of Columbus and bounded and described as follows:
 
Parcel No. 2: Being LOT NUMBER FOUR (4) of JAMES CHESTNUT'S ADDITION to the City of Columbus, Ohio, as the same is numbered and delineated upon the recorded plat thereof, of record in Plat Book 5, Page 312, Recorder's Office, Franklin County, Ohio.
 
To Rezone From:  C-4, Commercial District,
 
To:  CPD, Commercial Planned Development District.
 
 
SECTION 2.  That a Height District of Thirty-five (35) feet is hereby established on the CPD, Commercial Planned Development District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved CPD, Commercial Planned Development District and Application among the records of the Building Services Division as required by Section 3311.12 of the Columbus City Codes; said plans being titled, "REMOTE PARKING AREA"and text titled, "CPD TEXT", both signed by Jackson B. Reynolds III, attorney for the Applicant, and dated July 10, 2003, and the text reading as follows:

1.      INTRODUCTION: The site is part of the overall redevelopment plan for the southwest corner of East North Broadway and High Street.  The rezoning will permit parking and incorporate the High Street overlay standards for parking lot screening and setback.
 
2.       PERMITTED USES:   Parking for the development along North High Street between East North Broadway and Brighton Road (and east of the alley) and C-4 uses.
 
3.       DEVELOPMENT STANDARDS: Unless otherwise indicated in this text or the Site Plan, the development standards for C-4, as contained in Chapter 3355 of the Columbus City Code shall apply.
 
A.       Density, Lot, and/or Setback Commitments.  
 
1.      The parking setback from Brighton Road and High Street shall be 5 feet.
 
B.       Access, Loading, Parking, and/or Other Traffic Related Commitments.
 
1.      All circulation, curb cuts and access points shall be subject to the approval of the Division of Transportation.
 
             2.      The subject site shall have one access point to Brighton Road east of the alley and one access to the alley for the secondary curb cut.
 
C.       Buffering, Landscaping, Open Space, and/or Screening Commitments.
 
1.      The screening along Brighton Road and High Street shall comply with Section 3372.611(H).
 
2.      All trees and landscaping shall be well maintained.  Dead items shall be replaced within six months or the next planting season, whichever occurs first.
 
3.      All trees meet the following minimum size at the time of planting:
Shade trees 2 ½ inch caliper; Ornamental trees 1 ½ inch caliper;
Evergreen trees 5 feet in height.  Tree caliper is measured six (6)
inches from the ground.
 
D.       Building Design and/or Interior-Exterior Treatment Commitments.

E.       Lighting, Outdoor Display Areas, and/or other Environmental Commitments.
 
1.      All external lighting shall be cut-off fixtures (down-lighting) and shall be designed to prevent offsite spillage.
 
2.      All external outdoor lighting fixtures to be used shall be from the same or similar manufacturers type to insure compatibility.
 
3.      Accent lighting shall be permitted provided such light source is concealed from adjacent right-of-way.
 
4.      Any wall-mounted lighting shall be shielded to prevent offsite spillage.
 
5.      Light poles in the parking lot shall not exceed 18 feet in height.
 
6.      The average horizontal illumination level on the ground shall not exceed two and one-half (2 1/2) foot candles.  The light level along the property line adjacent to a residentially zoned or used property shall not exceed an average intensity of one-half (1/2) foot candle.
 
F.       Graphics and/or Signage Commitments.
 
1.      All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code as it applies to the CPD and any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.
 
G.      Miscellaneous Commitments.
 
      1.  The site shall be developed in substantial accordance with the Site Plan submitted herewith.  The Zoning Site Plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed.  Any slight adjustments to the Zoning Site Plan shall be subject to the review and approval by the Director of the Department of Development, or his designee, upon submission of the appropriate data regarding the proposed adjustment.
 
A.      CPD Criteria
 
1.      Natural Environment
 
The site is developed with an existing parking lot on property zoned C-4.
 
2.      Existing Land Use
 
To the north, south and east are commercial developments; to the west residential development.
 
3.      Proposed Use: Commercial parking for adjacent retail / restaurant.
 
4.      Transportation and Circulation
 
Access will be from an existing alley system and Brighton Road for the parcel frontage on High Street.
 
5.      Visual Form of the Environment
 
The visual form of the development will be established at the time of construction and is represented on the attached site plan.
 
6.      View and Visibility
 
View and visibility of the development shall be determined at the time of construction and the plantings and fencing should enhance the corner and not infringe on sight line visibility.
 
7.      Emissions
 
No adverse emissions are expected from this development.
 
B.      Variances
 
The parking setback is reduced from 10 feet to 5 feet to mimic the urban overlay standard.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
