Title: To amend Ordinance No. 0434-2008, passed March 17, 2008, by correcting the name of one of the event organizers to the Short North Business Association, and to declare an emergency.
Explanation
 
Ordinance No. 0434-2008, passed March 17, 2008, granted permission to various groups to apply for temporary liquor permits authorizing the sale of alcoholic beverages at special events to be held during 2008.  These organizations wish to sell alcoholic beverages to eligible patrons on various public streets and property to be used for the events.  The City of Columbus, acting by and through its Director of Recreation and Parks, is required to grant approval to the organizers of these events so they may obtain the required permits from the Ohio Division of Liquor Control.  It has since been determined that the name of one of the entities in the ordinance was incorrect.  The name in the original ordinance was listed as Park Street Fest, LLC.  The correct name of the organization should be the Short North Business Association.  This ordinance amends 0434-2008 to correct the name of the organization to the Short North Business Association.
 
Emergency action is requested so that the organizations can meet the permit deadlines as established by the Ohio Division of Liquor Control.

WHEREAS, on March 17, 2008, Columbus City Council passed Ordinance No. 0434-2008, authorizing the Director of Recreation and Parks to grant consent to various organizations to apply for permission to sell alcoholic beverages at the following special events during 2008: Earth Day; Komen Columbus Race for the Cure Survivor Reception; Street Fest on Park; Columbus Arts Festival; Waterfire; Festival Latino; Dancing & Rocking in the Streets; Comfest; Pride Festival; Red, White & Boom; North Market Food and Ohio Wine Festival; Jazz & Rib Fest; Riverfest; OSU Football Celebration; Varsity Club Crank-Up Parties; Hineygate Party; Hot Times Community Music & Arts Festival; Oktoberfest; Columbus Microbrew Festival; Via Colori Columbus and the Columbus Italian Festival; and
 
WHEREAS, it has since been determined that the name of one of the organizations in the ordinance was incorrect; and
 
WHEREAS, the correct name of the organization applying for the liquor permit should be the Short North Business Association; and
 
WHEREAS, the Short North Business Association is a non-profit organization and replaces the Park Street Fest, LLC for Street Fest on Park scheduled June 6-7, 2008; an
 
WHEREAS, this ordinance amends 0434-2008 to correct the name of the organization to the Short North Business Association; and
 
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to authorize the amendment to Ordinance No. 0434-2008, all for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That Section 1 of Ordinance No. 0434-2008 shall be amended to read as follows:
 
That the Director of Recreation and Parks be and is hereby authorized and directed to grant consent on behalf of the City of Columbus to the following organizations to apply for appropriate liquor permits to enable the non-profit groups to sell alcoholic beverages during the hours specified in said permits and at a specified locations during their 2008 special events:
  1. Green Columbus for Earth Day 2008, April 26;
  2. Komen Columbus for Komen Columbus, Race for the Cure Survivor Reception, May 3;
  3. Short North Business Association for Street Fest on Park, June 6-7;
  4. Greater Columbus Arts Council for the Columbus Arts Festival, June 6-8;
  5. Waterfire Columbus Inc. for Waterfire, June 14; Sept. 21;
  6. Ohio Hispanic Coalition for Festival Latino, June 20-21;
  7. Union Station Foundation for Dancing & Rocking in the Streets 2008, June 27-28;
  8. Community Festival for Comfest, June 27-29;
  9. Stonewall Columbus for the Pride Festival 2008, June 28;
  10. Red, White & Boom! Inc. for Red, White & Boom, July 3;
  11. North Market Development Authority for the North Market Food and Ohio Wine Festival, July 11-13;
  12. Friends of the Cultural Arts Center for the Jazz & Rib Fest, July 25-27;
  13. Boys & Girls Clubs of Columbus for Riverfest 2008, August 9;
  14. University Area Enrichment Association for the OSU Football Celebration, Aug. 30, Sept. 6, Sept. 20, Sept. 27, Oct. 11, Oct. 25 and Nov. 22;
  15. Kids-N-Kamp, St. Thomas More Newman Center, St. Stephen's Episcopal Church, and Neighborhood Services Inc. for the Varsity Club Crank-Up Parties, Aug. 30, Sept. 6, Sept. 20, Sept. 27, Oct. 11, Oct. 25, and Nov. 22;
  16. Children's Hunger Alliance, Big Brothers Big Sisters, Give Kids the World, The Childhood League Center, Charity Newsies, and Starr Commonwealth's Hannah Neil Center for the Hineygate Party on Aug. 30, Sept. 6, Sept. 20,  Sept. 27, Oct. 11, Oct. 25, and Nov. 22;
  17. Arts Foundation of Olde Towne for the Hot Times Community Music & Arts Festival, Sept. 5-7;
  18. German Village Society for Oktoberfest, Sept. 5-7;
  19. North Market Development Authority for the Columbus Microbrew Festival, Sept. 12-14;
  20. Via Colori, Inc. for Via Colori Columbus 2008, Sept. 12-14;
  21. Saint John the Baptist Italian Catholic Church for the Columbus Italian Festival, Oct. 10-12;  
 
SECTION 2.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
