Title: To authorize the Director of the Department of Public Service to execute those documents needed to transfer small portions of existing road right-of-way to Mountain Coal Company, LTD ("Mountain Coal"), WMAE Realty, LLC ("WMAE Realty"), and Atlas Supply Company, LLC ("Atlas Supply"); to accept proposed right-of-way needed for recently completed roadway improvements within the Arena District from Putnam Hill Company Limited Partnership, ("Putnam Hill"), WMAE Realty, Eastside Equipment Company, LLC ("Eastside Equipment"), Hanover Investment Company, LLC ("Hanover Investment"); and Mountain Coal; to the extent that they may apply to these transfers to waive the competitive bidding provisions and the Land Review Commission requirements of Columbus City Codes and to declare an emergency.
Explanation
1.  BACKGROUND
For the past several years, Nationwide Realty Investors ("NRI") and the City of Columbus ("City") have been actively involved in the redevelopment of that area of the City now known as "the Arena District".  As a part of this joint redevelopment project, several streets and alleys within the area have been rebuilt and/or improved.  
 
The plan for improvement of River District East Roadways - Part 3 (2474 DR E) identified Nationwide Boulevard, Brodbelt Lane, Hanover Street and Cozzins Street as streets that would benefit from the exchange of several small parcels of existing right-of-way for additional rights-of-way.  NRI facilitated the execution of General Warranty Deeds that transfer a total of 0.054 acres of additional right-of-way from Putnam Hill Company Limited Partnership, ("Putnam Hill"), WMAE Realty, LLC ("WMAE Realty"), Eastside Equipment Company, LLC ("Eastside Equipment"), Hanover Investment Company, LLC ("Hanover Investment") and Mountain Coal Company, LTD ("Mountain Coal") to the City.  In exchange for these dedications, the City has been asked to transfer 0.053 acres of existing right-of-way to Mountain Coal, WMAE Realty and Atlas Supply Company, LLC ("Atlas Supply").
 
After investigation it has been determined the exchange of these parcels of land is in the best interest of all the parties involved and should be authorized.  The City will retain a general utility easement for those utilities currently located within the portions of existing right-of-way being transferred to the adjacent property owners until all utilities have been relocated out of this right-of-way.

3.  EMERGENCY JUSTIFICATION
The construction facilitated by these exchanges has been completed and until these exchanges are finalized,  taxpayer funded roadway improvements are located on private property.  It is in the best interest of all parties to complete these exchanges as quickly as possible to legalize the City's use of this property for roadway purposes.

Body

WHEREAS, in exchange for these dedications, the City has been asked to transfer 0.053 acres of existing right-of-way to Mountain Coal, WMAE Realty and Atlas Supply Company, LLC ("Atlas Supply"); and
 
WHEREAS, after investigation and review of the plans it has been determined the exchanges proposed in this legislation are in the best interest of all parties and should be authorized subject to the retention of general utility easements for those utilities currently located within the existing rights-of-way being transferred by the City; and
 
WHEREAS, this legislation authorizes the transfer of several parcels of existing right-of-way, authorizes the acceptance of new right-of-way and to the extent to which they apply waives the competitive bidding and land review commission provisions of Columbus City Code; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that the roadway improvements facilitated by these exchanges have been completed using taxpayer dollars and these improvements are located on private property making it immediately necessary to authorize the Director of the Department of Public Service to execute those documents necessary to complete the exchanges thereby preserving the public health, peace, property, safety and welfare now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of the Department of Public Service be and is hereby authorized to execute quit claim deeds and other incidental instruments prepared by the Department of Law, Real Estate Division, necessary to transfer the following described 0.010 acre strip of right-of-way to MOUNTAIN COAL COMPANY, LTD.; to-wit:
 
         Situated in the State of Ohio, County of Franklin, City of Columbus, lying in Half Section 9, Section 8, Township 5, Range 22, Refugee Lands, being a part of the right-of-way of Cozzins Street as shown on that plat entitled W.A. Neil's Scioto Addition of record in Plat Book 5, Page 95, and described as follows:
         Beginning at an iron pin set at the southeast corner of Lot 1 as shown on said W.A. Neil's Scioto Addition, being the intersection of the west right-of-way line of Cozzins Street with the north right-of-way line of Spring Street;
         Thence North 03°22'36" East, with said west right-of-way line and the east line of said Lot 1, 130.11 feet to an iron pin set at the northeast corner of said Lot 1, being the intersection of said west right-of-way line with the south right-of-way line of a 20 foot alley (vacated in Ord. No. 970-02) as shown on said W.A. Neil's Scioto Addition;
         Thence South 87°05'03" East, with the north line of said Lot 1 extended, 3.50 feet to a right-of-way marker set;
         Thence South 03°22'36" West, 3.50 feet east of and parallel to said west right-of-way line, 130.12 feet to a right-of-way marker set in the south line of said Lot 1 extended;
         Thence North 86°55'37" West, with said south line extended and said north right-of-way line extended, 3.50 feet to the Point of Beginning, containing 0.010 acre, more or less.
         The bearings shown herein are based on the same meridian as the north right-of-way line of Nationwide Boulevard, having a bearing of North 82°18'16" East, per Ohio State Plane Coordinate System, South Zone, NAD83 (1986 Adjustment).

         Iron pins set, where indicated, are iron pipes, thirteen sixteenths (13/16) inch inside diameter, thirty (30) inches long with a plastic plug placed in the top bearing the initials EMHT INC.
         Right-of-way markers set, where indicated are solid iron rods, five eighths (5/8) inch in diameter, thirty (30) inches long with a plastic cap placed in the top reading "City of Columbus Right-Of-Way Marker".

         Beginning at an iron pin set at the northeast corner of Lot 1 as shown on said W. A. Neil's Scioto Addition, being the intersection of the west right-of-way line of Cozzins Street with the south right-of-way line of a 20 foot alley (vacated in Ord. No. 970-02) as shown on said W. A. Neil's Scioto Addition;
         Thence North 03°22'36" East, with said west right-of-way line, the east line of said vacated alley, and the east line of Lots 9 through 17, inclusive as shown on said W.A. Neil's Scioto Addition of record in Plat Book 5, Page 95, and described as follows:
         Beginning at an iron pin set at the northeast corner of Lot 75 as shown on said W.A. Neil's Scioto Addition and as shown on that plat entitled Neil's Subdivision of record in Plat Book 1, Page 394, being the intersection of the south right-of-way line of Nationwide Boulevard (former Dublin Avenue) with the west right-of-way line of Cozzins Street, referencing a P.K nail found at South 03°22'36" West, 0.61 feet;
         Thence North 82°18'16" East, with the north line of said Lot 75 extended and said south right-of-way line extended, 3.57 feet to a right-of-way marker set;
         Thence South 03°22'36" West, 3.50 feet east of and parallel to said west right-of-way line, 210.07 feet to an iron pin set in the south line of said Lot 75 extended;
         Thence North 87°30'41" West, with said south line extended and the north right-of-way line of a 20 foot alley (vacated in Ord. No. 970-02) as shown on said W.A. SECTION 4.  That the above referenced real properties shall be considered excess road right-of-way and the public rights therein shall terminate upon the Director's execution and delivery of said quitclaim deeds to the grantees thereof.
 
SECTION 5.  That general utility easements in, on, over, across and through the above described rights-of-way shall be and hereby are retained by the City of Columbus for those utilities currently located within these excess rights-of-way.
 
SECTION 6.  That upon notification and verification of the relocation of the existing utilities located within the retained general utility easements the Director of the Department of Public Service is hereby authorized to execute those documents necessary to release such retained general utility easements with no compensation due to the City and with no further legislative action required by the City.
 
SECTION 7.  That this Council has determined it is in the best interest of the City of Columbus to allow these rights-of-way to be transferred without requiring competitive bidding and hereby waives the competitive bidding provision of Columbus City Codes (1959) Revised, Section 329.29 with regards to the transfer of these rights-of-way.
 
SECTION 8.  That this Council has determined it is in the best interest of the City of Columbus to allow these rights-of-way to be transferred without requiring recommendations from Land Review Commission and hereby waives the Land Review Commission provisions of Columbus City Codes (1959) Revised, Section 328.01 with regards to the transfer of these rights-of-way.
 
SECTION 9.  That the City of Columbus hereby accepts the 0.004 acres more fully described below from PUTNAM HILL COMPANY LIMITED PARTNERSHIP; to-wit:
 
         Situated in the State of Ohio, County of Franklin, City of Columbus, lying in Half Section 9, Section 8, Township 5, Range 22, Refugee Lands, being out of Lot 16 as shown on the plat entitled "Brecount, Smith & Conover Northwest Addition" of record in Plat Book 1, Page 250 and conveyed to Putnam Hill Company Limited Partnership of record in Official Record 6651C16, and described as follows:
         Beginning, for reference, at the southwest corner of said Lot 16 and in the west line of historic Track Street, being a west line of that 0.726 acre tract conveyed to NWD 265 Neil, LLC of record in Instrument Number 200705040078814;
         Thence North 03°23'48" East, with the west line of said Lot 16 and partly with the south right-of-way line of Nationwide Boulevard (former Dublin Avenue), 30.44 feet to a right-of-way marker set at the True Point of Beginning;

         Situated in the State of Ohio, County of Franklin, City of Columbus, lying in Half Section 9, Section 8, Township 5, Range 22, Refugee Lands, being a part of Lot 81 as shown on those plats entitled Neil's Subdivision of record in Plat Book 1, Page 394, Change of Street by W.A. Neil of record in Plat Book 5, Page 45, and W.A. Neil's Scioto Addition of record in Plat Book 5, Page 95 conveyed to Eastside Equipment Company, LLC of record in Instrument Number 199812230331421, and described as follows:
         Beginning at the northwest corner of said Lot 81, being the intersection of the east right-of-way line of Hanover Street with the south right-of-way line of Nationwide Boulevard (former Dublin Avenue) as shown on said Change of Street by W.A. Neil and W.A. Neil's Scioto Addition;

         Beginning at the southwest corner of said Lot 8 and the intersection of the east right-of-way line of Hanover Street with the north right-of-way line of Spring Street;
         Thence North 03°22'36" East, with said east right-of-way line and the west line of said Lot 8, 129.34 feet to a ¾ inch iron pipe found marking the northwest corner of said Lot 8 and the intersection of the east right-of-way line of Hanover Street with the south right-of-way line of a 20 foot alley vacated in Ord. No. 970-02) as shown on said W.A. Neil's Scioto Addition;
          Thence South 87°05'03" East, with the north line of said Lot 8 and said south right-of-way line, 3.88 feet to an iron pin set;
