Explanation

 

Background: This legislation authorizes the Director of the Department of Public Utilities to enter into an agreement with Decker Construction Company for the 2022 Utility Cut Project.

 

There are various types of utility excavations that need to be performed within the City of Columbus' right-of-way and City owned properties by the Department of Public Utilities. The restoration work typically involves repair of existing pavement, curbs, and sidewalks in a manner conforming to the City of Columbus, Construction and Material Specifications (CMSC). The Department routinely outsources this restoration work to a contractor that is equipped and trained to make these repairs. Typical types of restoration work that require outsourcing involve the installation of wheelchair ramps, asphalt repair involving thermal bond heat weld repairs, asphalt milling machines capable of full width milling, and the delivery of flowable controlled density fill using volumetric mixer trucks.

 

Ordinance 3224-2022, authorized the original contract but was not specific in the details regarding the length of time the multi-year renewal term was authorized to achieve transparency about the length of the contract at its inception. Since the number and length of the renewals allowed was not specified in the original ordinance, we are requesting authorization for a new contract that covers the 2025 operating year. This contract shall not automatically renew. If unforeseen issues or difficulties are encountered that would require additional funding or a contract date extension, a modification would be requested.

The Department of Public Utilities solicited competitive bids through Vendor Services and Bid Express from October 11th, 2022 to November 9th, 2022, for the 2022 Utility Cut Project in accordance with the relevant provisions of Chapter 329 of City Code, RFQ023112. One (1) bid was received by Decker Construction Company and they were deemed the lowest, most responsive, and responsible bid.

 

Fiscal Impact:  $2,450,000.00 is available from within the Public Utilities Operating Funds to meet the financial obligations of this contract.

To authorize the Director of the Department of Public Utilities to enter into a service agreement with Decker Construction Company for the 2022 Utility Cut Restoration Project; to waive the competitive bidding provisions of Chapter 329 of the Columbus City Codes; and to authorize the expenditure of $2,450,000.00 split between the Electricity, Water, and Sanitary Sewer Operating Funds. ($2,450,000.00)

 

Body

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to enter into an agreement with Decker Construction Company for the 2022 Utility Cut Restoration Project; and

 

WHEREAS, the Department of Public Utilities solicited proposals for the 2022 Utility Cut Restoration Project in accordance with the provisions of Chapter 329 of City Code through RFQ023112; and

 

WHEREAS, Ordinance 3224-2022 authorized the initial term of the 2022 Utility Cut Restoration Project, but did not provide details regarding the length of time the multi-year renewal term, so authorization for a new contract must be acquired; and   

 

WHEREAS, the Department of Public Utilities wishes to enter into a service agreement for a period of one (1) year to and including December 31, 2025; and

 

WHEREAS, it is necessary to authorize the expenditure of $2,450,000.00 from the Public Utilities Operating Fund, split among the Electricity, Water, and Sanitary Sewer Operating Funds; and

 

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, to authorize the Director to enter into a contract for the 2022 Utility Cut Project with Decker Construction Company; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of the Department of Public Utilities is authorized to enter into an agreement with Decker Construction Company for the 2022 Utility Cut Restoration Project. The amount being authorized by this ordinance is $2,450,000.00. 

 

SECTION 2. That this Council finds it in the City’s best interest to waive the competitive bidding provisions of City Code, Chapter 329 for the contract with Decker Construction Company and does hereby waive the same. 

 

SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5. That the expenditure of $2,450,000.00 or so much thereof as may be needed, is hereby authorized from object class 03, Services, split among the Electricity, Water, and Sanitary Sewer Operating Funds, per the accounting codes in the attachment to this ordinance.

 

SECTION 6. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
