CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The site is currently zoned in CPD, Commercial Planned Development District.  This zoning request for the CPD District will remove stormwater related restrictions regarding out parcel development that are no longer needed, better defines use restrictions, and provides improved development standards that require headlight screening along Hilliard-Rome Road and landscaping on all out parcel boundaries.

WHEREAS, application #Z02-103 is on file with the Building Services Division of the Department of Development requesting rezoning of 3.60± acres from CPD, Commercial Planned Development District to CPD, Commercial Planned Development District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the site is currently zoned in CPD, Commercial Planned Development District.  This zoning request for the CPD District will remove stormwater related restrictions regarding out parcel development that are no longer needed, better defines use restrictions, and provides improved development standards that require headlight screening along Hilliard-Rome Road and landscaping on all out parcel boundaries, now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
1835 HILLIARD-ROME ROAD (43026), being 3.60± acres located on the west side of Hilliard-Rome Road, 243± feet south of Tanglewood Park Boulevard, and being more particularly described as follows:
 
Situated in the State of Ohio, County of Franklin, Virginia Military Survey Number 6542 and described as follows:
 
Beginning, for reference, at the intersection of the westerly right-of-way line of Hilliard-Rome Road with the southerly right-of-way line of Tanglewood Boulevard;
 
thence 07° 05' 39" East, with said westerly right-of-way line, a distance of 243.45 feet to the True Point of Beginning for this description;
 
thence 07 05' 39" East, with said westerly right-of-way line a distance of 654.49 feet to a point;
 
thence south 82° 54' 21" West, a distance of 240.00 feet to a point;

1.  INTRODUCTION:   The property was rezoned commercially in 1995 (Z95-068).  The zoning text contained a restriction on the amount of development along Rome-Hilliard Road due to stormwater retention requirements.  The stormwater issues have been resolved and the prior restriction is no longer necessary.
 
2.  PERMITTED USES:  Those uses permitted in Sections 3356.03 and 3357.01 (C-4 and C-5 districts) of the Columbus City Code.  However, none of the following shall be permitted:  billboard, book bindery, bus or truck terminal, poultry killing, stable, testing or experimental laboratory, tinsmith.   
 
3.  DEVELOPMENT STANDARDS: Unless otherwise indicated in this text or the Site Plan, the development standards for C-4, as contained in Chapter 3356 of the Columbus City Code shall apply.  However, the development standards for C-5 zoning, Code Chapter 3357, shall apply to any outlot which is developed as an automobile service station, combination automobile service station and convenience store, or other use which under the Code falls exclusively within the C-5 category.  
 
A.  Density, Lot, and/or Setback Commitments.  
 
The building and parking setbacks from Rome-Hilliard Road shall be 40 and 20 feet respectively except that a gas canopy may have a building setback of 30 feet.  This area may be crossed with utility lines.
 
B.  Access, Loading, Parking, and/or Other Traffic Related Commitments.
 
1.  All circulation, curb cuts and access points shall be subject to the approval of the Division of Transportation.
 
2.  One right-in/right-out curb cut shall be permitted along Rome-Hilliard Road.
 
3.  The outparcels shall have access to an internal driveway along their west boundary lines.
 
C.   Buffering, Landscaping, Open Space, and/or Screening Commitments.
 
1.  The developer shall install one tree for each 40 feet of frontage (grouped or spaced), along Rome-Hilliard Road.
 
2.  For all parking areas along Rome-Hilliard Road, a minimum screening height of 30 inches (60 inches maximum) shall be maintained along this frontage for the shielding of auto headlights as measured from the elevation of the nearest section of an adjacent parking area.  Such screening can be accomplished by the use of mounding, brick or stone structures, or landscaping material.
 
3.  Lot coverage to include: buildings, parking and service areas shall not exceed 85% of the designated lot (credit shall be given for setback areas if not paved).  
 
4.  For all loading areas, screening of opaque wood or brick or planting shall be a minimum of six (6) feet in height and be so designed as to interrupt vision into such areas from adjacent streets and properties.  All propane tanks and outdoor storage trash containers shall be fully screened as provided in fire and safety design standards.
 
5.  All trees and landscaping shall be well maintained.  Dead items shall be replaced within six months or the next planting season, whichever occurs first.
 
6.  All trees meet the following minimum size at the time of planting:  Shade trees 2½" caliper; Ornamental trees 1½" caliper; Evergreen trees 5 feet in height.  Tree caliper is measured six (6) inches from the ground.
 
7.  Each out parcel shall have a landscape buffer strip along its north, south and west boundary a minimum of 4 feet in width.  The buffer area shall be planted with either trees (15 feet on center) or a minimum 30-inch tall landscape hedge except at the access points.  
 
D.  Building Design and/or Interior-Exterior Treatment Commitments:  N/A
 
E.  Lighting, Outdoor Display Areas, and/or other Environmental Commitments.
 
1.  All external lighting shall be cut-off fixtures (down-lighting) and shall be designed to prevent offsite spillage.
 
2.  All external outdoor lighting fixtures to be used shall be from the same or similar manufacturers type to insure compatibility.
 
3.  Accent lighting shall be permitted provided such light source is concealed from adjacent right-of-way.
 
4.  Any wall-mounted lighting shall be shielded to prevent offsite spillage.
 
5.  Light poles in the parking lot shall not exceed 28 feet in height.
 
6.  If a canopy is constructed for gasoline sales, then canopy ceiling light fixtures shall not extend below the lowest edge of the canopy.
 
7.  Outdoor Display:  If a convenient store with gasoline sales is constructed on an out parcel then only that use may have outdoor display areas which shall comply with the following standards.
 
a.  Ends of each pump island, three (3) feet in width and four (4) feet in length.
 
b.  In front of the building along the sidewalk, four (4) feet in depth and twelve (12) feet in width.
 
c.  The maximum height for any outside storage areas shall be thee (3) feet.
 
d.  Any exterior propane storage enclosure or ice machine shall be located within the areas identified above for outdoor display but shall not be limited to 3 feet in height:
 
e.  The outdoor display areas shall contain only those items normally and customarily sold by a convenience store and other seasonal items and products, including but not limited to, fire wood, mulch, flowers, Christmas wreaths, etc.
 
F.   Graphics and/or Signage Commitments.
 
1.  All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code as it applies to the C-4 and any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.
 
2.  Any existing billboards in this sub-area will be removed within six months of the issuance of a building permit for any development which is within 150-feet of the north property line of this property.
 
G.  Miscellaneous Commitments.
 
The maximum number of out parcels shall be four (4).
 
H.  CPD Criteria
 
a.  Natural Environment:  The site is an undeveloped field.
 
b.  Existing Land Use:  To the north and south are commercial developments.
 
c.  Proposed Use:  Commercial
 
d.  Transportation and Circulation:  Access will be from Rome-Hilliard Road, Tanglewood Park Blvd. and internal access from the proposed development to the west.
 
e.  Visual Form of the Environment:  The visual form of the development will be established at the time of construction.
 
f.  View and Visibility:  View and visibility of the development shall be determined at the time of construction.
 
g.  Emissions:  No adverse emissions are expected from this development.
 
I.  Variances Requested
 
The building setback is reduced from 60 feet to 40 feet and to 30 feet for gas canopies.
 
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
