Explanation
Need: The Division of Police needs to purchase 109 Virtual Partner software licenses and additional software for the E-Ticketing hardware being installed in the 2008 police cruisers. These licenses and additional software must be purchased for the hardware to be operational. The Columbus Division of Police cruisers will have the ability to electronically issue traffic citations from the mobile computer in their patrol cars. The officers will be able to complete traffic citations in less than 60 seconds. The patented application captures data from the CAD/Mobile data system and auto populates an electronic version of the citation on a computer screen. The traffic offender's information is obtained using data returned from NCIC, motor vehicle queries or their driver's license. This application will increase law enforcement officers effectiveness and efficiency through time saving techniques that link law enforcement databases to the existing Franklin County Municipal Court Clerk's computer systems, enabling the immediate transfer of data between the Franklin County Municipal Court, the Franklin County Municipal Clerk's office, the Bureau of Criminal Identification & Investigation and the Bureau of Motor Vehicles.
Bid Information: Ordinance 1005-2007, approved by Columbus City Council on 06/14/07 authorized a contract between Franklin County Municipal Court for E-Ticket program with Advanced Public Safety (APS). Advanced Public Safety is the sole manufacturer and sole distributor of the Virtual Partner software, therefore this contract will be entered into in accordance with sole source procurement.
Negotiations were conducted with Advanced Public Safety to obtain the best possible pricing.
This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.

Emergency Designation: Emergency legislation is requested for this ordinance so that the new police cruisers will be fully functional as soon as possible.
FISCAL IMPACT:
The software licenses and additional software will be purchased with FY2007 Justice Assistance Grant Funds; therefore, there will be no impact on the financial status of the General Fund. The cost for annual maintenance will be $9,868.86 and will be billed starting in 2009.

To authorize and direct the Public Safety Director to contract for the purchase of software licenses and additional software from Advanced Public Safety for the Division of Police in accordance with sole source procurement; to authorize the expenditure of $65,000.00 from the Justice Assistance Grant (JAG); and to declare an emergency. WHEREAS, the City of Columbus Division of Police needs to purchase Virtual Partner software licenses and additional software so that the E-Ticketing hardware being installed in the 2008 police cruisers will be operational; and
WHEREAS, appropriated funds in FY2007 Justice Assistance Grant are needed to purchase the software licenses and additional software for E-Ticketing; and
WHEREAS, Advanced Public Safety is the sole manufacturer and sole distributor of Virtual Partner; and
WHEREAS, it is in the best interest of the City to enter into this contract in accordance with provisions of Section 329-07e (Sole Source) of the City of Columbus, 1959; and
WHEREAS, an emergency exists in the usual operation in the Division of Police, Department of Public Safety, in that it is immediately necessary to purchase Virtual Partner software licenses and additional software for E-Ticketing so that the new police cruisers will be fully functional as soon as possible and for the preservation of the public health, peace, property safety, welfare; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Safety Director be and is hereby authorized and directed to enter into contract with Advanced Public Safety for the purchase of Virtual Partner software licenses and additional software for E-Ticketing for the Division of Police, Department of Public Safety.
SECTION 2. That the expenditure of $65,000.00 or so much thereof as may be needed, be and the same is hereby authorized as follows:

SECTION 3. That said contract shall be awarded in accordance with provisions of Section 329.07e (Sole Source) of the Columbus City Code, 1959.
SECTION 4. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
