Explanation
 
A.      Background:  This legislation authorizes the Director of Public Utilities to enter into a construction contract with Elite Excavating Company of Ohio, Inc. for the Richards / Granden / Torrence Area Sanitary Relief Sewer & Roadway Improvement. The work consists of all labor and materials for the construction of approximately 2,550 feet of 12-inch to 24-inch sanitary sewer; 939 feet of 6-inch sanitary sewer service lateral; 12 sanitary and 16 storm manholes; 3,970 feet of 12-inch to 24-inch storm sewer; 5,969 feet of pipe abandonment; manhole and catch basin abandonments or removals; 12,917 square yards of full depth pavement reclamation; 5,781 feet of 18" curb w/ under drain; driveway and permanent pavement replacement; maintenance of traffic, and other such work as may be necessary to complete the contract in accordance with the plans and specifications. This project is required by the City's Consent Order. It is anticipated that the notice to proceed (NTP) will be issued during the first week of April 2013.  The project has a completion date of November 1, 2013.
 
B.      Procurement Information:  The Division advertised for competitive bids submission for the subject services on the City's Vendor Services website and in the City Bulletin in accordance with the provisions of Section 329.09 of the Columbus City Code. The Division of Sewerage and Drainage received nine (9) bids on January 9, 2013 from the following companies:

These bids were reviewed and ranked utilizing the Bid Tab and Quality Factor Form process. After reviewing the bids and the QFF form, it was determined that Elite Excavating Company of Ohio, Inc. was the lowest responsive, responsible, and best bid.

This company is not debarred or prohibited from being awarded this contract according to the Auditor of State's Unresolved Findings for Recovery.
 
D.  Emergency Designation:  Emergency designation is requested at this time. To ensure that all work on this project is completed before next winter, a completion date of November 1, 2013 was set.  We are requesting emergency legislation so that the contract process can be accelerated in order to meet the project deadlines.
E.  Economic Impact:
A public meeting was held during the design to field resident questions, concerns and issues in the area.  Another meeting will be held prior to the issuance of the NTP so that the residents can be informed of the potential impacts during construction.  This project is being completed as part of the City of Columbus Wet Weather Management Plan and will mitigate the activations at DSR337 to the required 10-year service level.
 
F.      Fiscal Impact:
This ordinance authorizes the Director of Public Utilities and the Director of Public Service to enter a construction contract to fund this project. This is a joint project between the Department of Public Utilites and the Department of Public Service. The legislation authorizes the transfer within of $205,319.35 and a total expenditure of up to $2,205,319.35 from the Sanitary Sewer General Obligation Fund, Fund 664 and an amendment to the 2012 Capital Improvements Budget.  It also authorizes the expenditure $713,995.44 from the Public Service Streets and Highways Bond Fund 704.

WHEREAS, the Richards / Granden / Torrence Area Sanitary Relief Sewer & Roadway Improvements Project is a joint venture between the Department of Public Utilities, Division of Sewers and Drains and the Department of Public Service; and
 
WHEREAS, it is necessary to authorize this ordinance to construct a sanitary relief/replacement sewer along Richards Road from Granden Rd., to the alley east of High Street in order to mitigate DSR 337 to the 10-year level of service as required by the City's consent order; and
 
WHEREAS, it is necessary to authorize the transfer and expenditure of funds within the Sanitary Sewer General Obligation Fund, Fund 664, to provide sufficient funding for the aforementioned project expenditure; and
 
WHEREAS, it is necessary to authorize the expenditure of funds from the Public Service, Street and Highways Bond Fund 704; and
WHEREAS, it is necessary to authorize an amendment to the 2012 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities in that it is immediately necessary for Council to authorize the Director of Public Utilities to enter into a construction contract with Elite Excavating Company of Ohio, Inc. for the Richards / Granden / Torrence Area Sanitary Relief Sewer & Roadway Improvements Project at the earliest practical date for the preservation of the public health, peace, property, safety and welfare; now, therefore,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities be, and hereby is, authorized to enter into a construction contract with Elite Excavating Company of Ohio, Inc.,4500 Snodgrass Road, Mansfield, Ohio 44903, for the Richards / Granden / Torrence Area Sanitary Relief Sewer & Roadway Improvements Project in accordance with the terms and conditions as shown on the contract on file in the office of the Division of Sewerage and Drainage.
 
SECTION 2.  That the City Auditor is hereby authorized to transfer $205,319.35 within the Sanitary Sewer General Obligation Fund, Fund 664, Division of  Sewerage and Drainage, Division 60-05, Object Level Three 6630 as follows:

SECTION 3.  That the 2012 Capital Improvements Budget Ordinance No. 0368-2012 is hereby amended as follows, to provide and create sufficient budget authority for the award of the agreement stated herein.

SECTION 5.  That the Director of Public Service be and hereby is authorized to expend a total of $713,995.44 for the Richards Rd. Roadway Improvements Project from the Streets and Highways General Obligation Bond Fund | Fund 704 | Division of  Design and Construction | Division 59-12 | Project # 530161-100018 | OCA 741618 | Object Level Three 6631.
 
SECTION 6.  That the said construction firm, Elite Excavating Company of Ohio, Inc., shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.   
      
SECTION 7.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
SECTION 8.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
SECTION 9 That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 10.  That for the reasons stated in the preamble hereto, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
